The Ministry received comments from the City of Greater Sudbury on December 23, 2022 indicating the site was not zoned for waste disposal. On March 23, 2023, the Ministry received a follow-up letter from the City of Greater Sudbury indicating the municipality had been in discussions with the company and that they had no objections if Ministry continued to process the application provided a condition was included prohibiting the construction and operation of the transfer facility until receiving confirmation from the municipality that all zoning issues had been addressed.

Given that the site had already received approval to operate on August 17, 2020 and that this application was for an amendment, Condition 1.12 was drafted limiting implementation of the proposed changes until:

  1. written concurrence from the municipality was received by the company;
  2. that information was provided to the District Manager; and
  3. the District Manager provided written concurrence to the company.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is to amend Environmental Compliance Approval (waste disposal site) No. A-500-5133138590 for a liquid waste transfer station located in Coniston, Greater Sudbury, Ontario. The proposed modifications include:

  • change the quantity of above-ground storage tanks to up to eight with a capacity of 60,000 litres each
  • addition of 45 square metres of the concrete pad with containment curbs, for a total of 225 square metres, increasing the bulk liquid transfer area for the above-ground vertical storage tank
  • increase the capacity of bulk liquid waste storage to 480,000 litres by adding three additional double walled vertical storage tanks of 60,000 litres each, for a total of eight above-ground double walled vertical storage tanks
  • allow blending, bulking and mixing activities in eight dedicated storage tanks
  • include the option to operate Environmental Compliance Approval No. 5822-BA7R8Y, for the collection, transmission, treatment and disposal of process water, leachate, stored water, surface water or groundwater impacted with petroleum hydrocarbons, gasoline, diesel fuel, oil, volatile organic compounds, polycyclic-aromatic hydrocarbons, halogenated and non-halogenated solvents, surfactants as well as other organic and inorganic contaminants, with mobile treatment units
  • bulking and transfer of liquid industrial waste and hazardous waste from/to a rail car located within the Coniston Industrial Park.

The facility may receive, ship, and process waste 24 hours per day, seven days per week.
