This decision is for a renewal and name change for a Permit to Take Water for GIP Properties Corp. After a thorough scientific and technical review, the director has renewed GIP Properties Corp water taking for a period of 10 years with no increase in the water taking volume. Water will be taken from the North Quarry Sump and South Quarry Sump related to dewatering, aggregate washing, dust control and manufacturing activities located in the City of Kingston, County of Frontenac, Ontario.

The Permit to Take Water (PTTW) issued to GIP Properties Corp. contains strict conditions and safeguards to protect existing water users and the natural environment, including:

  • conditions that require the permit holder to collect and record daily water taking rates and volumes
  • establish a monitoring program to undertake quarterly groundwater level monitoring of monitoring and private wells and submit that data annually to the Ministry’s District Office
  • ensure the discharge of water is carried out to prevent erosion, sedimentation and flooding in the receiving water body

The ministry considered the need to protect the natural functions of the ecosystem. The ministry is satisfied that the water taking does not interfere with existing wells located in the area, nor will the water taking result in unacceptable impacts to the environment and other existing users. The ministry is satisfied that the approved PTTW is protective of the environment.

No comments were received from the municipal / conservation authority stakeholders.

Comments relevant to the water taking proposal were considered as part of the review of the application. A summary of the comments and how they were considered are as follows:

  • Concerns related to impacts to existing well users and the environment. Thorough scientific and technical review was completed by the ministry to assess potential impacts of the proposed water taking. The ministry conducted field site visits to examine the discharge location and potential flooding impacts. The discharge location has been deemed appropriate from a flood perspective. Based on our observations and review, the ministry is satisfied that the water taking will not have an impact on neighbouring residential wells, water users, or structures.
  • It is noted that the ministry utilizes an adaptive management approach as part of the Permit to Take Water program and can amend permits at any time to reflect changing conditions. The proponent must comply with the terms and conditions of the permit, which are set to protect surrounding water users and the environment.
  • Concerns were identified with respect to a potential expansion of the quarry, and the volume of water takings to support an expansion. The issued permit is a renewal of an existing permit and does not permit any increased water takings. The Ministry of Natural Resources and Forestry (MNRF) is the lead regulatory oversight body for aggregate sites under the Aggregate Resources Act and oversees the review of applications for approvals for pits and quarries, including expansions.
  • Concerns were related to the operations at a concrete and asphalt plant. The Permit To Take Water does not regulate the operation of these facilities, however, any water taken to support operation of these facilities must be done in accordance with the terms and conditions of the Permit To Take Water. The ministry is satisfied that the on-going water taking at the site will not result in acceptable impacts to existing water takers or the environment.
  • Comments were submitted identifying inconsistencies in the information posted to the ERO. The ministry reviewed these concerns, and the application was updated by the proponent, and the original ERO posting was updated on October 18, 2022. The issued permit reflects accurate water taking sources and volumes.
  • Concerns were raised regarding potential impacts associated with discharge from the site. Discharge is managed under a separate Environmental Compliance Approval for Industrial Sewage Works.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
