The amendment to the existing Environmental Compliance Approval (waste disposal site), No. A110119 for Stelco Inc., was issued for the use and operation of a landfill site, with a total area of 5.50 hectares and a receiving capacity of a maximum of 420,000 tonnes annually, for the landfilling of the non-hazardous solid industrial wastes.

The site is located at 2330 Haldimand Road # Inc. Lake Erie Works and Stelco Hamilton Works and the hours of operation are 24 hours per day, 7 days per week.

This decision increases the capacity of 39,500 cubic metres via a 3.5 metres peak elevation expansion. This is an interim measure while long term 25 year expansion of the site is pursued under the Environmental Assessment Act.

The comment was pertaining to dust and visually seeing the vertical expansion. These concerns were taken into consideration and discussions took place with the Stelco and their consultant.

Ministry response

For dust

The waste does not produce dust as it "sticky" by nature. If any dust is coming off the property it do to the large property, roads, and the operation of the steel process. The landfill is a minor footprint of the site. The Environmental Compliance Approval has a Conditions that:

  1. the landfill shall be operated and maintained such that dust do not create a nuisance outside of the Stelco Inc. Lake Erie Works site; and
  2. the Owner shall place intermediate cover where landfilling has been temporarily discontinued for six months or more

These conditions and the nature of the waste address the concerns of the comment about dust.

For visual

The comment was concerned about the visual impact of the proposed vertical expansion are to the south-west of the landfill. It has been verified by Stelco personal that from Old Lakeshore Road the existing landfill is not visible. Given the distance and trees between any residential buildings and the landfill it is expected even with the limited vertical expansion the landfill will not be visible. The farm field to the west has not been active since approximately 2017 and there has been no occupant for roughly 40-50 years.

Stelco and their consultant has addressed the concerns of the comment about the visual impact from the landfill.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:

    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

The site is located at 2330 Haldimand Rd #3, Nanticoke, Ontario and has a final volumetric capacity of 1,300,000 cubic metres of waste. The service area is for Stelco Inc. Lake Erie Works and Stelco Hamilton Works and the hours of operation are 24 hours per day, 7 days per week.

The estimated date of reaching the approved waste design contours is January 1, 2023. This proposal is for an amendment to the existing Environmental Compliance Approval to allow for an increased capacity of 39,900 cubic metres via a 3.5 metre peak elevation expansion. This is an interim measure while long term 25 year expansion of the site is pursued under the Environmental Assessment Act.
