- the site description is changed from 1.2 hectares to 3.3 hectares area of the site.
- construction of a building is approved for indoor processing of the incoming waste.
- a new weigh scale is approved to be added to add third entrance to the facility from the thompson road.
- no change in operating hours of the site.

No comment was received in response to the ERO notice.
Neighbor notification
- In response to the Neighbor Notification, a response was received via email on September 11, 2022, from a nearby property, which is used for commercial operations. Though no specific technical concern was raised, the business owner requested that they be provided proper opportunity (retaining a consultant) to evaluate and comment on the proposal.
- A soft copy of the Design and Operations report was provided to the business owner on September 15, 2022, via email with a request to provide their input by October 15, 2022. No comments received thus far. Since the expansion does not involve approval of additional capacity and the building expansion will improve site operations as processing will take inside the building. We do not anticipate any negative impact on the environment associated with the proposed site expansion.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend Environmental Compliance Approval (waste disposal site) No. A-500-1210926002 for the processing, temporary storage, and transfer of non-hazardous solid industrial, commercial, and domestic waste. This facility is a 1.2 hectare property located in Norfolk County, Ontario.
The maximum quantity of waste delivered to the site on any given day is 550 tonnes, and 200,000 tonnes annually. The maximum storage capacity of the facility is 300 tonnes.
The facility processes waste between 6:00 a.m. to 6:00 p.m. Monday to Friday, and 7:00 a.m. to 4:00 p.m. on Saturday, excluding statutory holidays. The facility receives and transfers waste between 6:00 a.m. to 10:00 p.m. Monday to Friday, and 7:00 a.m. to 6:00 p.m. on Saturday, Sunday, and statutory holidays.
The proposed amendment includes:
- expanding the facility from 1.2 hectares to 3.3 hectares
- adding a new transfer building for the processing and transfer of recyclable materials
- adding a site entrance along Thompson Road West with a scale house
- adding scissor docks with roll-off bins for the public to drop off waste
