A new Environmental Compliance Approval was granted to 1287755 Ontario Inc., operating as Pinnacle Acres, for on-site sewage treatment and surface discharging system to serve a two-modular bunkhouse for accommodating a total of 96 people residing on-site and washroom facilities serving greenhouse and office for a maximum of 25 staff, located at 435 County Road 18, in the Municipality of Leamington.
The approved works, developed in two phases, are designed with a total treatment capacity of 26,000 litres per day, consisting of:
- two grease interceptors
- two septic/sludge tanks
- an electro-chemical phosphorus removal unit
- a pump tank
- a sludge tank
- an aeration tank
- a clarifier tank
- a dosing tank
- one Waterloo Biofilter System including chemical dosing and recirculation systems
- one sand filter
- one UV Disinfection
Final effluent will be discharged via final effluent disposal facility consisting of a diversion/disposal tank and discharge pipes into a municipal drain - the 4th Concession Road Drain.

Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

This proposal is for a new Environmental Compliance Approval (sewage) for 1287755 Ontario Inc. for a proposed expansion of the on site sewage treatment system to service a 2-phase development of a proposed greenhouse facility, located at 435 County Road 18 in the Municipality of Leamington, County of Essex, Ontario.
Phase 1 is currently under construction and includes a 10,000 litre per day septic system.
The application for sewage works includes the Phase 1 grease interceptor, anaerobic digester and pump tank which will remain and be incorporated into the new system.
The sewage works will be expanded with additional grease interceptor and anaerobic digester and an added Waterloo Biofilter Systems tertiary treatment system.
The proposed treatment system has been designed for a peak flow of 26,000 litres per day. The effluent will be discharged to the 4th Concession Road Drain at the southeast corner of the property.
