The approval is granted for the establishment and operation of a 7.89 ha hectares waste disposal site (processing and transfer) to be used for the receipt, processing, temporary storage and transfer of solid non-hazardous waste from residential, commercial, industrial, institution and construction sites generated within the Province of Ontario.

Approval is granted to amend the existing waste Environmental Compliance Approval for the following:

  • increase in daily incoming waste limit from a maximum of 150 tonnes per day to 3,000 tonnes per day
  • approval of inside storage limit from 80 tonnes to 3,000 tonnes 
  • outside storage limit increase from 250 tonnes to 3,000 tonnes
  • hours of operations approved for 6 days between Monday through Saturday for 12 hours/day which is proposed to change for 7 days a week, 24 hours a day through Monday through Sunday
  • construct a new processing /sorting building capable of indoor storage of all incoming solid non-hazardous waste and underground storage tank for about 1000 gallons capacity
  • approval of accepting and processing excess soil, source separated organics and blue box recyclable materials to the incoming waste stream
  • expansion of the existing site onto a southern neighboring property at 1232 Rosewarne Drive, Bracebridge, ON

  • Submission of a Traffic Impact Study to the Ministry of Transportation of Ontario
  • Removal of existing wood waste at 1232 Rosewarne Drive, Bracebridge, ON, property

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to the existing Environmental Compliance Approval No. 9443-7RYJ7W for the use and operation of a waste disposal site, with a total site area of 6.94 acres, to be used for waste transfer and processing of solid non-hazardous waste limited to commercial, institutional and industrial sectors, including:

  • wood
  • metals (aluminum, ferrous metals, copper)
  • asphalt shingles
  • drywall
  • plastics
  • construction and demolition waste

The waste processing includes:

  • screening
  • sorting
  • wood chipping/grinding

The waste transfer and processing facility under the current Environmental Compliance Approval No. 9443-7RYJ7W has a maximum daily receiving rate of 150 tonnes of waste and a maximum storage limit of 80 tonnes of waste indoors and 250 tonnes of waste outdoors.

The proposed amendment is to allow a maximum daily receiving rate of 3,000 tonnes and a maximum storage limit of 3,000 tonnes of waste indoors, and 3,000 tonnes of waste outdoors (with combined total of wood waste, drywall or asphalt shingle of 300 tonnes and maximum combined total of metal waste or chipped wood of 700 tonnes) at any time.

The proposed amendment also includes the following:

  • An increase to the annualized average daily waste transfer limit from 150 tonnes to 1,000 tonnes
  • The construction of a new processing /sorting building capable of indoor storage of all incoming solid non-hazardous waste
  • The addition of additional waste classes of excess soil, source separated organics and blue box recyclable materials to the incoming waste stream
  • The installation of equipment for processing wood/construction & demolition waste in the new processing/ sorting building

The waste disposal site is serving the Province of Ontario. Current hours of operation are 12 hours a day, 6 days a week (Monday through Saturday). The proposed amendment is to allow operations at the site 24 fours a day, 7 days a week (Monday through Sunday).
