OPA No. 13 is a site specific amendment that pertains to 2 parcels of land located in the Municipality of Shuniah. The first parcel of land is known municipally as 1015 Cedar Bay Road and is legally described as Macgregor PT ML 13E White's Survey and RP 55R-13875 Part 1 (the "retained" parcel). The second parcel of land is known municipally as 1049 Cedar Bay Road and is legally described as PT ML 13E White's & PT, Water lot in front of 13E, RP 55R-10743, Part 1&2, PCL 26153 TBF (the "severed" parcel).

Details of instrument decision
The purpose of Official Plan Amendment No. 13 (OPA # 13) is for a site specific policy amendment to Section 13.3(ii) of the Shuniah Official Plan in order to remove the right of severance from the retained parcel of land (1015 Cedar Bay Road) and transfer the future severance potential to what is now the severed lot (1049 Cedar Bay Road). Approval of OPA #13 permits the creation of one new buildable lot (for residential use) from a severed parcel of land held in unity of ownership as of January 15, 1979. Both subject parcels are located in the Shoreline Residential designation which permits residential uses.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).
Notice of appeal
Your notice of appeal must include:
- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Description of Instrument
The purpose of the Official Plan Amendment (OPA No. 13) is for a site specific policy amendment to Section 13.3(ii) of the Shuniah Official Plan in order to remove the right of severance from the retained parcel of land (1015 Cedar Bay Road) and transfer the future severance potential to what is now the severed lot (1049 Cedar Bay Road). The effect will allow for the creation of one new buildable lot from a severed parcel of land held in unity of ownership at January 15, 1979.
Each of the subject lands are occupied by a single-detached dwelling used for residential purposes. Both parcels are located in the Shoreline Residential designation which permits residential uses. Each parcel has unused lands which could accommodate an additional severance. The amendment would transfer the severance potential from the retained parcel to the previously severed parcel.The owner of the previously severed parcel proposes to sever the land to permit development for residential purposes. The Amendment is site specific and only applies to the subject properties.
