Résumé de l’avis

This decision is to amend Permit to Take Water No. 6551-8U3H95 for mining purposes. Water will be taken from nine lakes and nine wells, located in the Township of Dubreuilville, District of Algoma, Ontario. This amendment is for the modification of water taking sources.

Pourquoi une consultation n’est pas nécessaire

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 14, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO # 019-1778 for public comment from May 13, 2020 to June 12, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Effects of consultation

  • Two concerns were received from local Indigenous Communities regarding the cumulative environmental impacts of this water taking and surrounding water users. Also, how these takings may impact their Aboriginal and Treaty rights to harvest fish, wildfowl and medical plants.
  • These comments were considered during the evaluation of the proposal.
  • A meeting was also held with one community to discuss their concerns and included technical support from MECP. Following the discussion, the community had no further concerns.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
