A new amended Environmental Compliance Approval is granted to Hacienda North Farms Inc. for stormwater management works serving the Phase 3 greenhouse expansion site located at 2961 Talbot Trail,Lot 193, Concession Romney Talbot Road West, in the Municipality of Chatham-Kent, Ontario, together with existing stormwater management works serving Phases 1 & 2 greenhouses.
The approved facilities consist of the following:
- roof water drainage pipe systems, swales and on-site storm sewers, discharging roof top runoff and other surface runoff to the stormwater detention ponds
- stormwater management pond (catchment area 18.215 ha): stormwater management pond located at the north west corner of the property (serving Phases 1 and 2)
- the Phase 1 and 2 stormwater management facility is:
- designed to contain the 1:100 year storm event providing a pond storage volume of 21,273.60 cubic meters with a maximum water depth of 2.506 meters and a release rate of 796.0 litres per second
- complete with a 304 millimeter freeboard and a 750 millimeter diameter outlet pipe and an emergency spillway, discharging into the Coatsworth-Robinson Extension Drain post-development peak flows for all storm events up to and including the 100-year return storm event
- one oil/grit separator, receiving discharge from approximately 0.55 hectare parking lot, having:
- a sediment capacity of 1,000 litres
- oil capacity of 500 litres
- a total holding capacity of 1,500 liltres
- a maximum treatment flow rate of 24 litres per second
- discharge via sewers into the stormwater detention pond of the Phases 1 & 2 described above
- the Phase 3 stormwater management facility located near the East property limit that has:
- a storage volume of 10,826.80 cubic meters with a maximum water depth of 1.98 meters and a release rate of 1078.0 liters per second
- a 370 millimeter freeboard and a 600 millimeter diameter outlet pipe and outlet structure discharging into Lake Erie
- an emergency spillway available to allow discharging into the east line ditch

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to Environmental Compliance Approval No. 9565-AP8QCB for stormwater management works to serve the Hacienda North Farms Phase 3 Greenhouse Expansion, located at 2961 Talbot Trail in Wheatley, Ontario.
The stormwater management facilities consist of the following:
- Roof water drainage pipe systems, swales and on-site storm sewers, discharging roof top runoff and other surface runoff to the stormwater detention ponds.
- Stormwater management pond located at the north west corner of the property serving Phases 1 and 2, designed to contain the 1:100 year storm event providing a pond storage volume of 21,273.60 cubic meters with a maximum water depth of 2.506 meters and a release rate of 796.0 litres per second. This facility is complete with a 304 millimeter freeboard and a 750 millimeter diameter outlet pipe and an emergency spillway, discharging into the Coatsworth-Robinson Extension Drain located along the 2nd Concession Line.
- Phase 3 contains approximately 15.23 hectares of greenhouse roof area, to attenuate post-development peak flows for all storm events up to and including the 100-year return storm event. The Phase 3 stormwater management facility is located near the East property limit provides a storage volume of 10,826.80 cubic meters with a maximum water depth of 1.98 meters and a release rate of 1078.0 liters per second. This facility is complete with a 370 millimeter freeboard and a 600 millimeter diameter outlet pipe and outlet structure discharging into Lake Erie. In addition, an emergency spillway is available to allow discharging into the east line ditch.
