We issued an Environmental Compliance Approval to Cyanide Destruct Systems Inc. for their subject waste transfer and processing facility located at 293 Saunders Road, Barrie, to allow the replacement of three existing tanks with one new tank.
The tank will be located indoors on an impermeable surface, and spill containment has been assessed as adequate to contain any spills from this tank.

We received one online comment and one comment via email for this site, both from the same commenter. The items raised in these comments were as follows:
- The tank must be located indoors on an impermeable surface.
- Spill containment should be adequate to hold 120% of the tank volume.
- The company should account for vibration from the nearby train when designing the tank installation.
- The City should be notified in the event of a spill.
- The Ministry must be notified in the event of a spill.
These comment were considered and addressed as follows:
- The tank will be located indoors on an impermeable surface.
- The spill containment available is roughly 190% of the tank volume.
- The company indicated that other tanks that have been on-site for 10 to 15 years have not shown any impacts from vibration, and so no requirements around potential vibration damage have been imposed.
- The City is included in the list of contacts in the emergency response plan for the site.
- The company is required to notify the Ministry in the event of a spill further to Part X of the EPA.

Appeal process for decisions published before June 1, 2021

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

This proposal is to amend Environmental Compliance Approval (waste disposal site) No. A620200 for a waste processing and transfer facility located in the City of Barrie, County of Simcoe, for the processing of liquid industrial waste and hazardous waste.
The amendment seeks to replace three existing tanks used to hold industrial wastewater, having a total capacity of 29,500 litres, with one tank with a 34,000 litre capacity. This action is being taken to increase the health and safety of employees working with the tanks. The current tanks lack openings on the side which prevent access for maintenance purposes. The new tank allows for access through a side-mounted manhole which facilitates tank maintenance and cleaning to be undertaken in a safe manner.
The site (Cyanide Destruct Systems Inc. also known as “CDS”) has a total area of 0.65 hectares on which the contained 1,115 square meters processing building is located. The total amount of waste does not exceed 200,000 litres and 65 metric tonnes at any time.
The facility processes cyanide waste and provides precious metal recovery services to the electroplating and heat treat industry throughout Canada and the USA. Hours of operation are from 6:00 a.m. to 8:00 p.m. Monday through Friday, with emergency on call service on weekends. The site services the Province of Ontario.
