Currently, untreated leachate from the landfill is incinerated by injecting it into the secondary chamber of the incinerator and water is used to cool the exhaust gases from in the incinerator.
Clean Harbors requested approval to:
- Establish a leachate treatment system and then use the treated effluent in the incinerator quench system. The treated effluent would be subject to high temperature evaporation of the leachate within the quench water system that cools the incineration exhaust prior to the exhaust air treatment systems.
- That during periods of drought/dry conditions, when potable water is used as quench water due to on site water shortage, non hazardous liquid waste that meets specific conditions be able to be utilized to offset the potable water use.
No changes to the environmental performance criteria of the incineration discharge were proposed by this amendment.
The application was reviewed in conjunction with an application to amend the Environmental Compliance Approval for the incinerator's air emissions, which can be viewed under 019-5297.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

Leachate management for the Clean Harbors Lambton Facility landfill is approved through the waste Environmental Compliance Approval No. A031806. The high temperature incinerator operation and performance is approved through Environmental Compliance Approval Nos. A031813, 6547-565MSP, and 8-1030-94-006, that relate to:
- the receipt and storage of liquid wastes for incineration
- operation requirements
- performance monitoring
- stack emission requirements/confirmation testing
Currently, untreated leachate is injected into the secondary chamber of the incinerator.
Clean Harbors is applying for an amendment to the landfill Environmental Compliance Approval No. A031806 Condition 10(b) that would allow the treatment of the leachate generated on site and the disposal of the treated leachate through high temperature evaporation of the leachate within the quench water system that cools the incineration exhaust prior to the exhaust air treatment systems.
The leachate treatment system will be a closed loop system with air generated from the treatment directed to the incinerator air intake system, and the solid wastes processed through the Land Disposal Restrictions and returned to the landfill. The treatment will only occur when the incinerator is operating.
No changes to the environmental performance criteria of the incineration discharge are proposed by this amendment. In addition, Clean Harbors is requesting that during periods of drought/dry conditions, when potable water is used as quench water due to on site water shortage, non hazardous liquid waste that meets specific conditions provided in the supporting documents be able to be utilized to offset the potable water use.
The Lambton facility is permitted to receive liquid and solid wastes from Ontario and the United States, and is permitted to operate 24 hours per day, 7 days per week.
