On October 16, 2023, we approved a new Environmental Compliance Approval (ECA) for 2607572 Ontario Inc. for a waste disposal site (transfer/processing). The facility is a 0.8 hectare property located in Toronto, Ontario.

The site will accept solid non-hazardous plastic waste from residential, industrial, commercial, and institutional sources located within North America. The maximum quantity of waste delivered to this site on any given day is 20 tonnes and a maximum of 678 tonnes of waste will be stored at the facility at any one time.

The waste management activities that may be carried out within the facility include:

  • the receipt, temporary storage and transfer of waste
  • the grinding, washing and drying of plastic waste
  • the bulking and blending/mixing of residual amounts of subject waste that may be found at the bottom of the incoming empty plastic waste containers, limited to liquid industrial waste and characteristic waste under the following Ontario Waste Classes: 114, 122, 135, 145, 148, 212, 213, 222, 233, 242, 262, and 263.

Except for one 12 tonne container for the storage of solid non-hazardous waste, all waste unloading, storage, processing and loading will be conducted indoors.

The facility operates from 7:00 a.m. to 7:00 p.m. Monday to Friday and from 8:00 a.m. to 4:00 p.m. on Saturdays year-round, unless otherwise restricted by local by-laws.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (waste disposal site) for a hazardous and non-hazardous solid and liquid waste transfer and processing facility. The facility is a 0.8 hectare property located in the City of Toronto, Ontario.

The waste being processed at this facility is high-density polyethylene that is processed, granulated, and washed to yield raw materials fit for manufacturing. The facility has the capacity to process up to 20 tonnes of waste per day and store up to 200 tonnes of waste.

The facility operates from 7:00 a.m. to 7:00 p.m. Mondays to Fridays, 8:00 a.m. to 4:00 p.m. on Saturdays, and is closed on Sundays.

As waste is processed, byproduct wastes are generated, yet are captured in a saturated brine which is then stored and disposed of by licensed liquid waste removal services. The facility receives waste from Canada and the United States.
