An amended Environmental Compliance Approval was issued to Gay Lea Foods Co-operative Limited for approval of sewage works for the treatment and subsurface disposal of industrial process wastewater, consisting of washwater from cheese processing operations and whey permeate from a whey concentration process, rated at a total maximum design capacity of 104,000 litres per day (for the treatment of 45,500 litres/day of washwater and 58,500 litres/day of whey permeate), serving the Ivanhoe Cheese Plant located in the Municipality of Centre Hastings, County of Hastings.
The approved sewage works consist of:
- one reverse osmosis (RO) system discharging the RO permeate to a new 36,000 litre balancing tank to level out the volume before it is directed to the existing aeration tank
- two membrane feed pumps (1 duty and 1 standby) to be installed in the existing aeration tank
- one new membrane filtration system consisting of one stainless steel membrane tank containing one MB3-4 membrane module complete with a stainless steel housing, medium-bubble diffused aerators and permeate piping
- one 1 chemical metering pump for dosing an alkaline solution for pH correction; complete with a spill containment rated for a 208 litre chemical drum
- one upgraded flow splitter
- one new pumping station housing two additional dual alternating pumps
- one existing previously approved leaching bed re-rated for the daily design sanitary sewage flow of 55,500 litres/day
- six 150 m long infiltration trenches consisting of 150 mm diameter perforated drains enclosed within high density polyethylene infiltrators (Quick 4 Equalizer 24)
- two provisional 150 m long infiltrator trenches consisting of 150 mm diameter perforated drains enclosed within high density polyethylene infiltrators (Quick 4 Equalizer 24) to be utilized in the event that additional subsurface disposal area is required

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend the existing Environmental Compliance Approval (ECA) No. 6700-B2XLPY issued on August 31, 2018 for approval of sewage works for the collection, transmission, treatment and subsurface disposal of industrial wastewater to serve the Ivanhoe Cheese Plant located at 11301 Highway 62 North in the Municipality of Centre Hastings, County of Hastings.
This amendment is for approval of sewage works for:
- the collection, transmission, treatment and subsurface disposal of whey permeate
- upgrades to the existing previously approved sewage works
- modifications to the existing previously approved monitoring program
- the addition of the Limited Operational Flexibility (LOF) condition to the amended ECA
The proposed upgrades to existing washwater and whey treatment system consist of:
- one reverse osmosis (RO) system discharging the RO permeate to one new 36,000 L balancing tank to level out the volume before it is directed to the existing aeration tank
- two membrane feed pumps (1 duty and 1 standby) to be installed in the existing aeration tank
- one stainless steel membrane tank containing one MB3-4 membrane module complete with a stainless steel housing, medium-bubble diffused aerators and permeate piping
- one chemical metering pump for dosing an alkaline solution for pH correction, complete with spill containment rated for a 208 litre chemical drum
Treatment and subsurface disposal of up to 58,500 L/day of treated RO permeate, consisting of:
- one upgraded flow splitter
- one existing pumping station housing two additional dual alternating pumps
- one existing previously approved leaching bed rated up to 55,500 L/day
- four new 150 m long infiltrator trenches consisting of 150 mm diameter perforated drains enclosed within high density polyethylene infiltrators (Quick 4 Equalizer 24)
- four new provisional 150 m long infiltrator trenches consisting of 150 mm diameter perforated drains enclosed within high density polyethylene infiltrators (Quick 4 Equalizer 24) to be utilized in the event that additional subsurface disposal area is required
