Application 60-C-219066 to sever 24 hectares from PIN 42055-0199 to be added as a lot addition to PIN 42055-0205 was approved on December 22, 2021 as applied for, subject to standard conditions and the following conditions:

  1. That prior to final approval, this Ministry is to be provided written confirmation of adequate capacity to dispose of hauled sewage generated by the severed and retained lands. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, referencing the disposal facility and the related Ministry of Environment, Conservation MECP approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the proposed severed lot.
  2. That prior to final approval, the Ministry must be advised by the Northwestern Health Unit that the retained lands and the severed lands have been inspected and are suitable for the installation of a subsurface sewage system or that the existing systems meet their requirements.
  3. This Ministry is to be advised in writing by the transferor that the Offer of Purchase and Sale agreement, or alternatively an acknowledgement by the transferor and transferees if the transaction is between family members, contains the following clause:
    1. Property owners must make application for new Ministry of Transportation Entrance Permits once the lands have been transferred and title registered. The new permits are required to reflect the change in property descriptions. If the owner of the property receiving the lot addition desires an entrance to Hwy 609, they must make application for an entrance permit prior to constructing it. The application will be reviewed in accordance with current highway access policies and will only be permitted if it meets those policies.
    2. In accordance with the Public Transportation and Highway Improvement Act, (MTO) Building and Land Use Permits are required for any development/construction occurring within 45 metres of the property limit of a provincial highway or within 180 metres of the centre point of an intersection between a public sideroad with a King’s or Secondary Highway.
    3. Ministry permits are required prior to any development/construction taking place.

The last date of appeal under the Planning Act is January 11, 2022.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

The purpose of this application for consent is to sever a rectangular portion of land, approximately 24 hectares, from PIN 42055-0199 (currently 26 hectares) and transfer to the abutting PIN 42055-0205 (currently 18.3 hectares). The addition would result in PIN 42055-0205, currently vacant and un-serviced, being approximately 42.3 hectares with 343 metres of frontage on Highway 609 and a depth of 812 metres. The proposed severed lot and the lot to which it will be added are currently and proposed to be vacant and used for resource-based recreational use. The remaining lot, PIN 42055-0199, would be approximately 2 hectares, with 27 metres of frontage on Highway 105 and a depth of 200 metres. There is currently an abandoned commercial office building on the retained lot serviced by a well and septic system. The subject lands are located approximately 8.1 kilometres north of the Municipality of Machin municipal boundary. The subject lands are accessed by Highway 105 (with frontage on Highway 609) and are located in the unorganized community of Red Lake Road, in Wabigoon Township, in the District of Kenora.
