Application 60-C-218316 was approved on May 2, 2022, subject to the following conditions:
- That this approval applies to permit to create a lot addition of 0.37 hectares to be transferred from Lot 4, Plan 23M888 to be added to Lot 5, Plan 23M888 while 0.37 hectares would be retained and added to Lot 3, Plan 23M888, as applied for, on Lake of the Woods in the above noted location in unsurveyed territory in the District of Kenora.
- That the following documents be provided for the transaction described in Condition 1:
- A copy of the application to transfer documents;
- A schedule to application to transfer on which is set out the entire legal description of the parcel(s) in question. This Schedule must also contain the names of the parties indicated on application to transfer; and
- >A reference plan of survey, which bears the Land Registry Office registration number and signature as evidence of its deposit therein, illustrating the parcel(s) to which the consent approval relates; and/or a legal description of the lands to be severed which is acceptable to the land registrar.>
- That prior to final approval, an application to consolidate the severed portion of Lot 4, Plan 23M888 with Lot 5, Plan 23M888 be prepared and an undertaking from the person registering the documents shall be required agreeing to register the consolidations once the land transfers have been registered.
- That prior to final approval, an application to consolidate the retained portion of Lot 4, Plan 23M888 with Lot 3, Plan 23M888 be prepared and an undertaking from the person registering the documents shall be required agreeing to register the consolidations once the land transfers have been registered.
- That prior to final approval, the Ministry must be advised by the Northwestern Health Unit that the retained lands, together with Lot 3, Plan 23M888; and the severed lands, together with Lot 5, Plan 23M888 have been inspected and are suitable for the installation of a subsurface sewage system or that the existing systems meet their requirements.
- That prior to final approval, this Ministry is to be provided written confirmation of adequate capacity to dispose of hauled sewage generated by the severed and retained lands. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, referencing the disposal facility and the related Ministry of the Environment, Conservation and Parks (MECP) approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the proposed severed lot.
The last day to appeal the application is May 22, 2022.
Effets de la consultation
Concerns identified related to the cumulative impacts of development on Lake of the Woods were received. Concerns had no impact on the decision as the effect of this application to split Lot 4 plan 23M888 in half and consolidate the halves with adjacent lots minimizes the chance of site alteration and new built form and results in a net decrease of one subdivision lot on Lake of the Woods. Concerns related to engagement and ministry processes are outside of the scope of this application and did not impact the decision.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

The purpose of this application is to add 0.37 hectares from Lot 4 to Lot 5, with the remaining lands added to Lot 3. The proposed lands to be severed are 0.37 hectares with 25 metres of frontage and 161 metres of depth. The retained lot would be 0.37 hectares with 25 metres of frontage and 136 metres of depth. The lot to which the severed lands will be added are 0.75 hectares with 22 metres of frontage and 161 metres of depth. The lands to which the remaining parcel will be consolidated with are 0.65 hectares with 50 metres of frontage and 136 metres of depth. The owners of Lot 5 and Lot 3 purchased as joint tenant’s Lot 4 which is the lot between their respective lots in Plan 23M888. The intention has always been to split the lot in half via lot addition to enlarge each of their respective lots. Both the severed and retained lands are currently vacant and no development is proposed. The lands are currently and proposed to be used for resource-based recreational use. The lands receiving the addition, and the lands which will be consolidated with the retained lands each contain a resource-based recreational dwelling, and no changes are proposed. The intention is to create more privacy between the two lots. Each of the resource-based recreational dwellings are serviced by an approved septic system, lake water for domestic purposes with drinking water brought in. The lands are located on an island known as Shragges Island, south of Treaty Island and are accessed by water only.
