Sewage treatment plants are heavily regulated precisely because their failure to perform can cause immediate and significant environmental harm.

The risk of harm is heightened in the case of the Minaki treatment plant, where effluent from the plant flows out a short pipe directly into the Winnipeg River, and where the plant is in unorganized territory, with no municipal oversight of plant operation or backup after plant failure. 

The refusal of the Ministry to follow its own rules and require updated water quality baseline studies for the Winnipeg River leaves the risk that the plant's treatment limits are inconsistent with the River's current condition, and that stricter limits and additional treatment are needed to avoid unacceptable degradation of water quality.

Furthermore, tertiary sewage filtration techniques are readily available and typically used which, if added to the Minaki plant, would further improve effluent quality in any event. 

The refusal of the Ministry to require additional filtration before discharge of effluent directly into the Winnipeg River results in a level of contamination of the River that could easily be avoided and that immediately and certainly worsens River water quality.

Effets de la consultation

The existing sewage works were inspected on October 2018 by a professional engineer with a consulting engineering firm in presence of representatives of the Owner and the Ministry. No equipment or structure failure was observed. The approval also has conditions imposed regarding preparation of a statement by a professional engineer that the sewage works have been restarted in accordance with the approval, and the preparation of as-built drawings within 6 months of start up of the sewage works. Any deficiencies in the sewage works have or will be rectified prior to startup of the sewage works. There is no change in the quantity of quality of raw sewage influent to the sewage treatment plant, treated effluent discharged to the receiver or there has been no change in the treated effluent discharge location.

The site is located within an unorganised area hence there is no municipal oversight. The site and all the structures, cabins and restaurant etc including the sewage works are existing. There are conditions imposed including the submission of Financial Assurance to the Ministry in case of a possible future default by the proponent.

Submission from legal counsel for Minaki on the River (MoR) indicate that the site is owned by three corporations which have identical Officers, Directors and Shareholders.

The sewage works have been previously deemed to be capable of meeting the stipulated effluent criteria imposed on the ECA and there should be no issues if the sewage works are operated by a licensed operator. The approval stipulates the requirement that the sewage works be operated by a licensed operator. MoR has noted that the Ontario Clean Water Agency (OCWA) will be contracted to operate the sewage treatment plant on their behalf. OCWA operates numerous sewage treatment plants in the Province and has competent and knowledgeable staff capable of operating the sewage treatment plant at MoR site.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Description of instrument

The proposal is for amendment of Environmental Compliance Approval (Municipal and Private Sewage Works) No. 7471-9LVPLH, issued on August 28, 2014 to Minaki on the River Inc. for an existing Sewage Treatment Plant (STP), located in Minaki, Ontario.

The existing sewage treatment plant was previously approved to serve a condominium type development. The Owner now intends the change the servicing from condominium development to a seasonal recreational vehicle trailer park, including a restaurant.

There are no changes to the existing sewage works, to the quantity or quality of the treated effluent nor the outlet discharge to the Winnipeg River.
