The subject lands are accessed by Inglis Road, a road maintained by the Inglis Lake Locals Roads Board.

Application 60-C-219956 for the creation of an easement for ingress and egress over PIN 42150-1739 to benefit PIN 42150-3093 was approved on November 9, 2021, with a last date of appeal of this decision under the Planning Act of November 29, 2021, subject to standard conditions including:

  1. PIN 42150-0739 for the benefit of PIN 42150-3093, as applied for, on Lake of the Woods in the above noted location in unsurveyed territory in the District of Kenora.
  2. That the following documents be provided for the transaction described in Condition 1:
    1. A copy of the application to transfer documents;
    2. A schedule to application to transfer on which is set out the entire legal description of the parcel(s) in question. This Schedule must also contain the names of the parties indicated on application to transfer; and
    3. A reference plan of survey, which bears the Land Registry Office registration number and signature as evidence of its deposit therein, illustrating the parcel(s) to which the consent approval relates; and/or a legal description of the lands to be severed which is acceptable to the land registrar.
  3. That the easement be registered and shown on the title for PIN 42150-0739 in favour of PIN 42150-3093.

The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, species at risk, water quality protection). As this application creates an easement to formalize access to an existing lot, no new development will result from this decision and there are no anticipated environmental impacts. No public comments were received, nor concerns identified.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Proposal Details

The purpose of this application is to create an easement for the purposes of ingress and egress as applied for in the Clearwater Bay area, Lake of the Woods in Unincorporated Territory, District of Kenora. The proposed easement would replace/relocate an existing easement on PIN 42150-0739, described as Part 4, Parcel 20705, Plan 23R-3382, which currently provides ingress and egress to PIN 42150-3093.

The proposed easement would be approximately 0.009 hectares, 6.0 metres wide and would extend approximately 15.2 meters over PIN 42150-0739. The dominant lands are approximately 0.53 hectares with approximately 30.0 metres of frontage and 180 metres of depth. The proposed easement would be approximately the same size of the existing easement on Part 4.

The subject lands are approximately 7.8 kilometers southwest of the City of Kenora municipal boundary. The lands are accessed by Inglis Road, maintained by the Inglis Lake Locals Roads Board.
