The director has approved the following waste and quantities to be accepted and processed at the site:
- non-hazardous solid municipal waste (construction and demolition): 80 tonnes per day and maximum storage on-site of 160 tonnes at any time
- liquid industrial waste (water supply, sewer clean out): 20 cubic meters per day and maximum storage at any time of 60 cubic meters
- liquid industrial waste (contaminated with petroleum and cement slurry): 35 cubic meters daily and maximum storage of 120 cubic meters
- hydrovac slurry waste (liquid soil): 300 cubic meters daily and maximum soil storage of 1,230 cubic meters
Conditions have been imposed in the approval requiring the applicant to provide the following:
- an updated Financial Assurance by July 30, 2023 (condition 1.17)
- restriction on the acceptance and processing of hydrovac slurry (liquid soil) (condition 2.7)
- preparation of an updated design and operations report (condition 3.8)
- submission of an impact assessment and its approval by the director (condition 3.9)

Though there was no comment received in response to ERO posting, there was one comment received in response to a neighboring notification. Therefore, the number of comments received as a result of ERO posting are indicated to be none.
That said, the comments received as a result of neighboring notification directly to the director were considered as part of the approval process. The comments included:
- the site is not fenced
- waste is stored close to the fence line
As a result, the approval requires the following to be implemented:
- installation of perimeter fence for site security
- visual screening of the site
- no waste storage within 10 meters of the fence line

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend Environmental Compliance Approval No. 6469-ADXJVG to modify operations at the Maple Creek Processing and Transfer Facility, a 1.75 hectare site located in the City of Ottawa, Ontario, operated by Norris Construction Management Inc.
The facility is a waste disposal site used for the temporary storage, transfer, and processing (including dewatering) of non-hazardous liquid waste and soil material from the cleaning of water supply lines, storm sewers, and sanitary sewers, and inert construction waste being sorted to separate recyclable materials from waste.
The waste received is generated by residential, municipal, and industrial, commercial and institutional sources within a service area of Eastern Ontario. Liquid waste will be transported to sewage treatment plants, and soil material will be taken to licensed treatment and disposal sites or used as fill material if it meets ministry standards for commercial land use.
If approved, the daily maximum waste volumes for liquid industrial waste will increase from 3.65 cubic metres to 20 cubic metres, with maximum storage volumes being amended to 60 cubic metres from 14.06 cubic metres. For inert construction waste, the daily maximum waste volume will increase from 15 tonnes to 80 tonnes with maximum storage volumes increasing from 80 tonnes to 160 tonnes.
The facility is also seeking approval for new processing facilities to treat hydrovac slurry waste and hydrocarbon contaminated liquid industrial waste. The receipt of hydrovac slurry will occur in three phases, with the maximum daily waste amount being:
- phase 1 allowing 300 cubic metres
- phase 2 allowing 600 cubic metres
- phase 3 allowing for 900 cubic
Hydrocarbon or cement contaminated liquid industrial wastes will not exceed a daily maximum volume of 35 cubic metres and a maximum storage of 120 cubic metres.
Maximum storage volumes for hydrovac slurry soils will be:
- 1,230 cubic metres for phase 1
- 2,460 cubic metres for phase 2
- 3,690 cubic metres for phase 3.
Water removed from hydrovac slurry will be reused within the treatment process.
The facility operates from 8 am to 5 pm, Monday to Saturday.
