The subject lands are accessed to the south by Balantine (aka Ballantyne) Road from Dog Lake Road (Highway 589).

Application 58-C-215876 was approved on July 30, 2021. Conditions were added. Applicants have one (1) year to satisfy conditions otherwise approval will lapse. The last day that this decision can be appealed is August 19, 2021.

Non-standard condition includes:

  • That prior to final approval, this Ministry is to be advised in writing by the transferor that the Offer of Purchase and Sale agreement, or alternatively, an acknowledgement by the transferor and transferees if the transaction is between family members, contains the following clause:
    • There have been confirmed cyanobacteria blooms in the Hawkeye Lake Watershed in the last few years, including a reported bloom on Two Island Lake in June 2021. As such, a precautionary approach to any additional development within this lake’s watershed is needed to prevent further water quality deterioration in Hawkeye Lake, as well as other lakes in the watershed.

On June 21, 2021, as a result of public notice being posted in the local paper, one (1) email was received requesting additional information regarding 58-C-215876. Further to the request, the inquirer was sent a copy of the application form and sketches provided with the application. On June 23, 2021, the inquirer responded and stated that as there is no intensification of development, they have no objection to the application.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Proposal Details

The purpose of this application for consent is to create an easement for access purposes over the vacant property described as PIN 62327-0380 (Part 1 & Part 2) for the benefit of the abutting vacant property described as PIN 62327-0381 (Part 3 & Part 4) to the east. The proposed easement would be approximately 0.02 hectares in size, with a width of 3.0 metres and extending approximately 75.0 metres over PIN 62327-0380. PIN 62327-0381 is approximately 0.67 hectares with 53.0 metres of lake frontage, 30.5 metres of road frontage, and a depth of 155.0 metres. PIN 62327-0381 is approximately 0.64 hectares with 55.0 metres of lake frontage, 34.1 metres of road frontage, and a depth of 140.0 metres. Both lots are proposed to be developed in the future for resource-based recreational purposes to be serviced by lake water and sewage systems.

The subject lands are located on Two Island Lake, approximately 18.2 kilometres north of the City of Thunder Bay municipal boundary. The subject lands are accessed to the south by Balantine (aka Ballantyne) Road from Dog Lake Road (Highway 589), maintained year-round by the Jacques Local Roads Board.
