Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Proposal Details
The purpose of this application for consent is to sever a triangular portion of land, approximately 0.33 hectares, from PIN 42150-0919, Lot 3, Plan M-363 to PIN 42150-0992, Lot 4, Plan M-363 to adjust property boundaries between two adjacent shoreline properties as an existing septic system is encroaching over property lines. The proposed severed lot (Lot 3) is approximately 0.53 hectares with 35,0 metres of shoreline frontage and an average depth of 85.0 metres. The proposed receiving lot (Lot 4) is approximately 0.33 hectares with 17.0 metres of shoreline frontage and an average depth of 46.5 metres.
There are existing dwellings on both subject lands, constructed in the 1990s, and the use is not proposed to change. Both severed and retained lands are serviced by lake water and privately owned and operated septic systems.
The subject lands are located on Spruce Lake in Unincorporated Territory, in the District of Kenora, approximately 1 kilometre south of the City of Kenora municipal boundary. The subject lands are accessed to the south by 4 Fire Road 29 (PIN 42150-1320) from McKenzie Portage Road, maintained year-round by the McKenzie Portage Local Roads Board.
