Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).
Notice of appeal

- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Proposal Details
The purpose of this formal application for consent is to sever a rectangular portion of land on the shoreline road allowance, approximately 0.002 hectares (Part 1 55R14636) from PIN 62459-0044 (Part 2 55R5004) and transfer to the abutting PIN 62459-0045 (Part 3 55R5004) due to the encroachment of an existing retaining wall located on Part 1. The proposed severed lot is approximately 0.06 hectares with 30.5 metres of shoreline frontage and a depth of 20.1 metres. The proposed receiving lot is approximately 0.06 hectares with 29.8 metres of shoreline frontage and a depth of 20.1 metres. The subject lands are vacant (no buildings/structures) and are un-serviced. There are no proposed changes to the use of the subject lands.
The subject lands are located on Whitesand Lake in the Unincorporated Township of Killraine, District of Thunder Bay, approximately 5.1 kilometres west of the Township of Schreiber municipal boundary. The subject lands are accessed by Whitesand-Winston Road which is maintained by the Whitesand Local Roads Board.
