We did not approve application (PP 220 20) for an amendment to the Niagara Escarpment Plan (NEP) for a site-specific policy exception to sever a dwelling subject of a Heritage Conservation Easement Agreement and create a new lot, and in doing so facilitate the conveyance of conservation lands to a public body.
The Niagara Escarpment Commission (NEC) received formal notification from the applicant on November 11, 2021 that they wished to withdraw the application.
NEC has formally closed the file.

The proposed amendment (PP 220 20) is seeking to create a 0.4 ha (1 ac) new lot containing a dwelling with a Heritage Conservation Easement Agreement, with a remnant lot of approximately 1.99 ha (4.9 ac), containing a single dwelling and garage. The remaining lands of approximately 21.8 ha (53.8 ac), would then be conveyed to the Credit Valley Conservation, and used in part to facilitate the permanent route of the Bruce Trail. The placement of the lands in public ownership is contingent upon the severance of the heritage dwelling in the manner proposed by this application.
A Niagara Escarpment Commission (NEC) Development Permit was issued for the subject lands in 2014 which included a Condition of Approval requiring the existing brick farmhouse to be retained through a heritage designation and registered easement under the Ontario Heritage Act. The subject property is listed on Appendix 3 to the Niagara Escarpment Plan and any future severance of the farmhouse is identified as being prohibited as a surplus or second dwelling.
Public consultation opportunities
Pursuant to Sections 7 and 10 (1) of the Niagara Escarpment Planning and Development Act, the NEC has provided copies of the proposed Amendment to the affected Ministries and relevant municipalities. Additionally, the proposal has been circulated to landowners within 120 metres of the subject property. Comments will also be invited by means of an advertisement in the local newspaper and posting on the NEC website.
