Pursuant to Section 53 of the Planning Act, provisional consent was granted on May 27, 2021 in respect of Application 54-C-204775 to transfer a 0.07-hectare piece of land in a lot addition from PIN 61218-0107 to PIN 61218-0106, in Maisonville unincorporated township, Timiskaming District. The last day this decision can be appealed is June 16, 2021.

54-C-204775 was approved on May 27, 2021 with conditions. Application No. 54-C-204775 will sever a roughly rectangular piece of land approximately 0.07 hectares in size (approximately 46.83 metres deep with 13.72 metres frontage on the lake) from the southern portion of PIN 61218-0107 to be consolidated in a lot addition to the benefitting lot, which is immediately south.

Following the lot addition, the benefitting lot will increase from 0.16 hectares to approximately 0.23 hectares in size and have 46.5 metres of frontage on the lake. The benefitting lot currently contains a cottage, septic system, three sheds, and a gravel parking area. A dock and a portion of the gravel parking area currently encroach on PIN 61218-0107, the lot addition would correct the encroachment.

Following the lot addition, the remainder of PIN 61218-0107 will be approximately 1.25 hectares in size, have 277.20 metres of frontage on Lake Sesekinika, and be approximately 43.65 metres deep (at narrow part). The retained lot contains a cottage, a bunkie, a garage, two sheds, a septic system, a dock, and a gravel parking area.

No new buildings or structures were proposed as a result of this application. All lands are accessed using a private access locally referred to as ‘800 Road’, which is accessed via Highway 570.

The application was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received, and no concerns were identified. The decision to approve the consent is consistent with the Provincial Policy Statement, this decision will not have a significant impact on the environment.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before June 16, 2021.

The applicant has one (1) year to satisfy conditions, otherwise approval will lapse.

Non-standard conditions include:

  • Prior to final approval, the Ministry of Municipal Affairs and Housing is to be advised in writing by Ontario Northland that the owners of both properties involved in this transaction have each entered into a crossing agreement with Ontario Northland to their satisfaction.
  • That a notice be registered to the title of both properties involved in this transaction regarding the necessity of a crossing agreement with Ontario Northland. Prior to final approval, the Ministry of Municipal Affairs and Housing is to be advised in writing by Ontario Northland that a satisfactory notice has been prepared. A legal undertaking from the person registering the documents shall also be provided agreeing to register the notice on title.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario
