An amended Environmental Compliance Approval (air) with Limited Operational Flexibility has been issued to Kirkland Lake Gold (formerly Detour Gold Corporation) for their Detour Lake Project.

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin as because the proposal was posted on May 14, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO number 019-1725 for public comment from May 14, 2020 to June 28, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision

An amended Environmental Compliance Approval (air & noise) with Limited Operational Flexibility has been issued to Detour Gold Corporation, a gold mining and processing facility located in the Town of Cochrane, District of Cochrane, Ontario.

The emission sources from the manufacturing and associated processes that exhaust to the air include open pit gold mining operations, drilling operations, ore crushing, and ore processing. The amendment includes new dust collection equipment at the secondary crusher, an increase in the mills production limit from 75,000 tonnes of ore per day to 32,850,000 tonnes per year, and to document changes made under the Limited Operational Flexibility condition.

Emissions to the air from this facility include total suspended particulates, nitrogen oxides, carbon monoxide, potassium, and nickel.

The Environmental Compliance Approval with Limited Operational Flexibility (air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (air). The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.

The name of the proponent has changed from Detour Gold Corporation to Kirkland Lake Gold Inc. during the processing of this proposal. Therefore the ECA was issued to Kirkland Lake Gold Inc.

There was also an error in the proposal posted on May 14, 2020. The ECA to be amended by this decision should be 6778-8YKQV9 instead of 4406-BNQSGP. The ECA issued has the correct ECA amended.

No comments were received.

Effects of consultation

Since we did not receive any comments during the commenting period, there is no impact of comment on the approval.

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
