Pursuant to Section 53 of the Planning Act, provisional consent was granted in respect of Application 58-C-189386 for the creation of one (1) new resource-based recreational lot for land described as PIN 62279-9513 and PIN 62279-9515, Whitefish Lake, Unincorporated Township of Hardwick & Jean, District of Thunder Bay.

The subject lands are on Whitefish Lake, accessed by Mileage 46 Road and Ontario Highway 588, and are approximately 60 kilometers southwest of the City of Thunder Bay.

Decision on instrument

58-C-189386 was approved on April 23, 2021. Conditions were added. Applicants have one (1) year to satisfy conditions otherwise approval will lapse.

The last day of appeal of this decision is May 13, 2021.

Non-standard conditions include:

  • That prior to final approval, the applicants shall enter into a Consent Agreement addressing the use and potential development of the lots including that the lots can only be used for resource-based recreational uses (including a recreational dwelling) and are not to be used for permanent residential use.
  • That prior to final approval, notifications for acknowledgement in all Agreements of Purchase and Sale, or alternatively, an acknowledgement by the transferor and transferees if the transaction is between family members, is required for standard Ministry and partner Ministry guidelines and policies including: shoreline Best Management Practices, land use compatibility, wild rice harvesting, waste disposal and potable water.
  • That prior to final approval, this ministry requires verification of the registration of lands considered as Lot 1 in the application (Ministry File No. 58-C-168346) will be required prior to the final granting of consent for lands described as Lot 2 and the retained lot.
  • That prior to final approval, the applicant and his solicitor shall:
    • i) Apply to the Director of Titles for an entry to be made on the register for the north portion of the severed land, Lot 2, (PIN 62279-9515) and the south portion of the severed land, Lot 2, (PIN 62279-9513).
    • ii) Apply to the Director of Titles for an entry to be made on the register for the north portion of the retained land, (PIN 62279-9515) and the south portion of the retained land, (PIN 62279-9513).
  • That prior to final approval, the ministry requires an undertaking indicating that the entries by the Director of Titles have been finalized prior to the creation of Lot 2 and the retained lot.

Appeal process for decisions published before June 1, 2021

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Proposal Details

The purpose of the applications is to create two (2) new resource-based recreational lots by severing & 62279-0083 (LT) in the geographic township of Hardwick, District of Thunder Bay. Application 58-C-189386 proposes to create one (1) resource-based recreational lot of approximately 8.14 hectares, with a frontage of 154 meters and a depth of 983 meters. The retained lot would be approximately 13.7 hectares with a frontage of 250 meters and a depth of 994 meters.

One (1) resource-based recreational structure and several out-buildings currently exist on the subject lands. The subject lands are on Whitefish Lake, accessed by Mileage 46 Road and Ontario Highway 588, and are approximately 60 kilometers southwest of the City of Thunder Bay.
