We have issued an Environmental Compliance Approval (sewage) to 2552221 Ontario Inc. for the establishment of swales and stormwater management works to service Lakeside Lodge in the village of Minett, located in the Township of Muskoka Lakes, District Municipality of Muskoka, Ontario.

The issued Environmental Compliance Approval (sewage) consists of the following:

  • oil and grit separator (catchment area 3.15 hectares):
    • one oil and grit separator
    • Stormceptor System Model STC 2000 or Equivalent Equipment
    • located on the east end of the site, providing Enhanced Level of protection
    • having a sediment storage capacity of 6,279 litres
    • an oil storage capacity of 2,890 litres
    • a total storage volume of approximately 10,595 litres
    • a maximum treatment rate of 277 litres per second
    • receiving inflow from the storm sewer located between residential units 29 and 30, discharging via a 450 millimetre diameter outlet pipe to Lake Rosseau located east of the site
  • surface storage (catchment area 1.60 hectares):
    • located in the parking lot on the southern portion of the site
    • having a maximum available storage volume of 177 cubic metres
    • a maximum ponding depth of 0.237 metres
    • discharging via a 300 millimetre diameter storm sewer equipped with a 75 millimetre diameter orifice
    • allowing a maximum discharge of 55 litres per second under the 100-year storm event to storm sewers located northwest of the parking lot
  • oil and grit separator (catchment area 1.00 hectares):
    • one oil and grit separator
    • Stormceptor System Model STC 750 or Equivalent Equipment
    • located northwest of the parking lot, providing Enhanced Level of protection
    • having a sediment storage capacity of 2,202 litres
    • an oil storage capacity of 915 litres
    • a total storage volume of approximately 3,921 litres
    • a maximum treatment rate of 15 litres per second
    • receiving inflow from the storm sewer located within the parking lot, discharging via a 300 millimetre diameter outlet pipe to the proposed grassed swale located northwest of the parking lot
  • rip-rap swale:
    • located northwest of the parking lot
    • having a total length of 10 metres
    • bottom width of 0.50 metres, depth of 0.30 metres
    • side slopes of 2:1
    • channel slope of 2%
    • complete with a filter fabric and 150 millimetre rip-rap
    • discharging to the existing drainage channel located west of the parking lot
  • grassed swales:
    • located within catchment 203
    • conveying overland runoff and discharging via existing storm sewers to Lake Rosseau

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:
