The ministry has issued a new Environmental Compliance Approval for 2738330 Ontario Inc. for stormwater management works to serve a gas station and store at 399 Main Street, Mount Forest, in the Township of Wellington North.
The approved stormwater management works comprise of stormwater quality control and erosion control works, installation of one oil/grit separator unit STC300 or equivalent equipment, located on the northeast side of the proposed development, providing enhanced level of protection.
The approved stormwater management works have:
- a sediment storage capacity of 1450 litres
- an oil storage capacity of 300 litres
- a total storage volume of approximately 1750 litres
- a maximum treatment rate of 9 litres per second
Inflow will be received from the storm sewers located on site, discharging via a 250 millimetre diameter storm sewer to an existing 300 millimetre diameter sewer on Main Street.

Summary of the comments
The comments are provided in regards to the Clean Water Act and municipal source water protection. The subject property with an estimated drainage area of 0.11 hectares is located in:
- Wellhead Protection Area A (WHPA-A) scoring 10
- Wellhead Protection Area B (WHPA-B) scoring 8
- Significant groundwater recharge area (SGRA)
Recommendations
- regular maintenance, monitoring and inspections by the owner to protect water quality
- direction to the owner that their property is located within a vulnerable area for the municipal wells
- the requirement for a spill response plan including instructions on how to report spills to the Ministry’s Spills Action Centre and notification to the municipality
- the ministry should consider the presence of the significant groundwater recharge area on the property and, if necessary, add conditions to the ECA to encourage recharge of contaminant-free water, such as roof runoff, to the aquifer
Ministry response
- In accordance with the Tables of Drinking Water Threats and Technical Rules, when the land use for the sewage works is industrial or commercial, the drainage area must be over 10 hectares to be a significant threat. The proposed stormwater management OGS and connection to municipal storm sewers are not a significant drinking water threat as the drainage area is not large enough to be a significant threat in an industrial or commercial land use.
- The Environmental Compliance Approval contains Condition 4, related to the operation and maintenance of the works. Condition 4 is included as regular inspection and necessary removal of sediment and excessive decaying vegetation from the Works are required to mitigate the impact of sediment, debris and/or decaying vegetation on the treatment capacity of the Works. The condition also ensures that adequate storage is maintained in the works at all times as required by the design. Furthermore, this condition is included to ensure that the works are operated and maintained to function as designed.
- The Environmental Compliance Approval contains Condition 7, related to the Spill Contingency Plan. Condition 7 is included to ensure that the owner will implement the Spill Contingency Plan, such that the environment is protected and deterioration, loss, injury or damage to any person(s) or property is prevented.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal
