An Environmental Compliance Approval (sewage) is granted to 1797517 Ontario Inc. for an upgraded sewage treatment and surface discharge system, servicing greenhouse Phase 4 development for accommodating:
- a total of 112 on-site workers
- up to 36 off-site employees at greenhouse and warehouse facilities
- four loading docks
The site is located at 633 Highway 77, in the Municipality of Leamington.
The approved sewage works are designed with a capacity of 32,000 litres per day, and consist of:
- a 9,100 L septic tank/pump chamber
- a 4,500 L septic tank
- a 13,600 L septic tank
- a 13,600 L equalization tank/pump station PS1
- a 40,000 L primary sedimentation tank comprised of 2 chambers
- two Moving Bed Biofilm Reactor (MBBR) cells with chemical dosing system
- one final clarifier
- one secondary sludge storage tank SS2
- one effluent pump station
- two bag filters
- one sand filter
- two UV disinfection units,
Final effluent will discharge final into an intermittent flow receiver, South Branch of Lebo Creek Drain along Highway 77.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend Environmental Compliance Approval (Sewage) No. 3950-87CLC8 issued to 1797517 Ontario Inc. The greenhouse farm is located at 633 Highway 77, Leamington, Ontario.
Approval is sought for the replacement of an existing wastewater treatment and subsurface disposal system with an upgraded wastewater treatment facility and surface discharge system, servicing the employment population of an existing vegetable greenhouse including accessory warehouse and office facilities, with staff residing on-site and off-site.
The project involves implementation of a new 22.7 cubic metres per day moving bed biofilm reactor (MBBR) wastewater treatment facility, including pre-treatment facilities comprised of existing septic tanks, flow equalization, primary sedimentation, MBBR biological treatment for carbon oxidation and nitrification, secondary sludge storage, alkalinity addition, pH adjustment, tertiary treatment including phosphorus removal through chemical precipitation, tertiary filtration and ultra violet disinfection, and a final effluent pump station for discharge to surface water.
The wastewater treatment facility is designed to achieve tertiary effluent quality required for dry-ditch discharge to the South Branch Lebo Creek Drain at Highway 77, which is tributary to Lebo Creek located within the Hillman Creek Watershed.
