The application for consent, 60-C-189826 is draft approved on February 10, 2021 subject to conditions. The last date to appeal the decision is March 2, 2021.The applicant has one year to satisfy standard conditions of draft approval, otherwise approval will lapse. Conditions include a requirement for an acknowledgement by both the transferor and transferee that: the proposed severed land may contain an old exploration shaft to which the Ministry of Energy, Northern Development and Mines does not have a current status on the site and therefore request the owners to exercise caution; and should a well be installed, water must be treated prior to consumption if it doesn’t meet the drinking water standards as established by the Province.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

The purpose of the application (60-C-189826) is to sever 16 hectares of land (all of PIN 42079-0255) and add it to the abutting PIN 42079-0256, a 32-hectare property to the south to provide road access to a landlocked property. Both PIN 0255 and 0256 are currently vacant. The retained farm property (PINs 0252, 0253 and 0254) will be 110 hectares in size and contains two dwellings serviced by two individual sewage systems and drilled wells. The property is accessed by Wabigoon Lake Road which is maintained by the Van Horne Local Roads Board.
