Requirements for public notification on the Environmental Bill of Rights registry do not apply where, in the minister’s opinion, the delay involved in giving notice to the public, in allowing time for public response to the notice, or in considering the response to the notice would result in:
- danger to the health or safety of any person;
- harm or serious risk of harm to the environment; or
- injury or damage or serious risk of injury or damage to any person.
An emergency Director's direction was issued under Section 29 of the Environmental Bill of Rights, 1993, S.O. 1993, c. 28 as it was determined that a delay could result in harm or serious risk of harm to the environment.

The Director provided emergency authorization to the company to operate both waste transfer facilities operating under until March 31, 2020.
The following factors were considered in making that determination:
Due to the COVID-19 pandemic, the Safety-Kleen Canada Inc. Breslau refining facility was shut down in mid-April 2020. This has resulted in increased holding times of used engine oils at two of their waste transfer facilities. Safety-Kleen Canada Inc. sought the ministry emergency approval for additional used oil storage capacity of 160,000 litres (2 frac tanks) and 80,000 litres (1 frac tank) on a temporary basis at the transfer stations located at: 25 Regan Road, Brampton and 60 Bury Court, Brantford respectively until March 31, 2021. The Breslau refining facility is anticipated to restart operations in the fall of 2020. Providing relief will allow Safety-Kleen Canada Inc. to continue removing used engine oil from service centres ensuring safe operation of people’s vehicles on the roads and will also allow the Breslau re-refinery to catch up and process used oil being stored. No environmental impact is anticipated from the approved temporary storage of used engine oil.
With the exception of the temporary increased storage, the issued direction also required the company to follow all conditions stated in the related Environmental Compliance Approval, as well as to follow additional monitoring and reporting requirements related to the provided Direction.
Once issued, the company was able to temporarily store additional waste oil.
