On June 12, 2022, we approved an amendment to Environmental Compliance Approval (waste disposal site) No. 0229-99QJS7 for Recycling Makes Cents Ltd., a 2.56 hectare solid non-hazardous waste transfer/processing facility located in the City of Windsor, County of Essex.
The approved amendments are to:
- increase the maximum amount of waste received from 30 tonnes/day to 500 tonnes/day, with 200 tonnes/day for cross-docking (all waste to remain in trailers with no allowance for overnight storage) and 300 tonnes/day for storage/processing on site
- increase the maximum baled waste storage in Section B of the storage building from 95 tonnes to 164 tonnes
- increase the maximum baled waste storage in Section C of the storage building from 31.5 tonnes to 108 tonnes
- increase the maximum unbaled waste storage in Section B of the storage building from 5 tonnes to 50 tonnes
- increase the combined maximum outdoor storage of clean wood waste and scrap metal from 15 tonnes to 80 tonnes of wood waste and 20 tonnes of scrap metal
- add "white goods" (fridges, freezers etc.) to be stored as scrap metal
- increase the maximum storage of waste electrical and electronic waste from 1 tonne to 20 tonnes
- increase the maximum storage of crushed waste lamps from one 205-litre drum to six 205 litre drums
- add a maximum storage of 1 tonne of intact waste batteries stored in six 205-litre drumspoly-lined drums
- add a maximum storage of 360 empty metal or plastic drums and lids to be stored indoors
- add a maximum storage 120 empty IBC totes and 60 stack of plastic pallets to be stored outdoors

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is to amend environmental compliance approval (waste disposal site) number 0229-99QJS7 for Recycling Makes Cents Ltd., a 2.56 hectare solid non-hazardous waste processing facility located in the City of Windsor, County of Essex. The maximum amount of waste to be received daily is 500 tonnes, and the maximum storage capacity of the facility is 500 tonnes. The site operates from 8am to 5pm, Monday to Saturday.
The proposed amendments include:
- increase the maximum amount of waste received from 30 tonnes/day to 500 tonnes/day
- increase the maximum baled waste storage in Section B of the storage building from 95 tonnes to 180 tonnes
- increase the maximum baled waste storage in Section C of the storage building from 31.5 tonnes to 90 tonnes
- increase the maximum unbaled waste storage in the storage building from 5 tonnes to 50 tonnes
- increase the combined maximum outdoor storage of clean wood waste and metal from 15 tonnes to 100 tonnes
- add a maximum of 20 tonnes of "white goods" (fridges, freezers etc.) to be stored as steel
- increase the maximum storage of waste electrical and electronic waste from 1 tonne to 20 tonnes
- increase the maximum storage of crushed waste lamps from one (1) 205-litre drum to six (6) 205 litre drums
- add a maximum storage of 1 tonne of waste batteries stored in poly-lined drums
- add a maximum storage of four (4) 205-litre drums of household batteries
