OPA No. 14 is a site specific amendment that pertains to a parcel of land located on Lambert Island in the Municipality of Shuniah. The subject land is known municipally as 30 Lambert Lane and is legally described as Lot 13, Registered Plan 55M-505, Township of MacGregor, in the Municipality of Shuniah, in the District of Thunder Bay.

The purpose of the Official Plan Amendment (OPA # 14) is for a site specific policy amendment in order to facilitate the creation of a new buildable lot from the subject land on Lambert Lane on Lambert Island.
The owner/applicant would like the opportunity to create a second lot. To sever the desired second lot, the owner/applicant needs to amend the "Land Division Criteria" Section 13.2(iv) of the OP which currently requires that "The proposed lot must front on a publicly owned and maintained road by the Township." The road Lambert Lane is publicly owned, but privately maintained. OPA # 14 would modify the Plan for the subject property to permit the requested severance to occur.
The OPA was reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). No public comments were received or concerns identified. The decision to approve the OPA is consistent with the Provincial Policy Statement and will not negatively impact the environment.
The last day to appeal this decision on 58-OP-199606 is December 12, 2020.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

The subject land fronts onto a public road (Lambert Lane), which is privately maintained. The Official Plan requires that a proposed lot must front on a publicly owned and publicly maintained road by the Municipality. The proposed amendment would relieve this requirement for this property only and would not affect any other property.
