Update Announcement

Permit number 4812-BPZJRK was revoked and replaced with permit number 2677-BW5LFV on December 10, 2020 to correct an administrative issue with the preceding permit. The new permit imposes the same terms and conditions as the previous permit.

An amendment to existing Permit No. 8342-B8HK9Y was issued to support Penguin-Calloway (Vaughan) Inc. project for dewatering activities related to a proposed construction at 175 Millway Avenue, in Vaughan, Ontario.

Pourquoi une consultation n’est pas nécessaire

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1670 for public comment from April 28, 2020 - May 28, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

This proposal was for an amendment to existing Permit No. 8342-B8HK9Y to support a Penguin-Calloway (Vaughan) Inc. project for dewatering activities related to a proposed construction at 175 Millway Avenue, in Vaughan, Ontario.

This amendment was requested to increase the temporary construction water taking from 528,900 L/day to 3,550,000 L/day. Four (4) sources of taking (drilled wells) for construction dewatering were identified, as follows:

  • maximum volume (litres) per day: 887,500
  • maximum number of days of taking in a year: 365

  • period of water taking: 4 years

The amended Permit To Take Water, number 4812-BPZJRK was issued on May 29, 2020, and expires May 31, 2024.

The comment received identified concern with the posting under Ontario Regulation 115/20. The comment was considered, and information on why consultation isn't required is provided in the above section.

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect. On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
