On June 24, 2020 the Minister of the Environment, Conservation and Parks issued a permit to Natural Resource Solutions Inc. under subclause 17(2)(b) of the Endangered Species Act.

Under clause 17(2)(b) of the ESA, the minister may issue a permit authorizing a person to engage in an activity that would otherwise be prohibited by sections 9 or 10 of the ESA if the minister is of the opinion that the main purpose of the activity is to assist, and that the activity will assist, in the protection or recovery of the species specified in the permit.

Assisting in the protection or recovery of the species

The multi-faceted recovery project for Mottled Duskywing includes:

  • the continued development and execution of mark-resighting studies
  • the continued execution of a population genetics and landscape ecology study
  • the continued execution of a density dependence experiment
  • the development and implementation of habitat manipulation studies to inform a best management practices guide for maintaining early successional habitats
  • the continued implementation of a captive rearing program to facilitate reintroductions to previously occupied sites and new sites with suitable habitat
  • reintroductions to previously occupied sites, and new sites with suitable habitat, while developing and implementing short-term and long-term monitoring programs and experiments to investigate the success of reintroductions

Other information

The minister is required to consider any government response statement (GRS) to a recovery strategy published under subsection 11(8) of the Act.

A GRS has been published for Mottled Duskywing and was considered. It was determined that the project activities aligned with many of the priority actions listed in the GRS.

We are not required to consult on this permit as it relates to an insect (Mottled Duskywing) and therefore does not meet the required criteria set out in subsection 1.3(6) of Ontario Regulation 681/94 of the Environmental Bill of Rights, 1993.

We are voluntarily posting this notice to advise the public of this proposal and to invite the public to submit written comments to the contact person identified in this notice.

Natural Resource Solutions Inc. has applied for a Species Protection or Recovery permit under clause 17(2)(b) of the Endangered Species Act, 2007. The permit proposal is to continue a multi-faceted recovery project for Mottled Duskywing at 16 study sites across Ontario.

Protecting species under the Endangered Species Act

Sections 9 and 10 of the Endangered Species Act (ESA) provide protection for individual members of a species and their habitat if that species is listed on the Species at Risk in Ontario List as either:

  • extirpated
  • endangered
  • threatened

Mottled Duskywing is listed as an endangered species and is therefore protected.

Under clause 17(2)(b) of the ESA, the Minister may issue a permit authorizing a person to engage in an activity that would otherwise be prohibited by sections 9 or 10 of the ESA if the Minister is of the opinion that the main purpose of the activity is to assist, and that the activity will assist, in the protection or recovery of the species specified in the permit.

Other information

The Minister is required to consider any government response statements that have been published under section 12.1 of the ESA for the relevant species. A government response statement for Mottled Duskywing has been published.

Posting this proposal on the Environmental Registry does not imply that we will issue a permit. A permit may only be issued where the legal requirements set out in clause 17(2)(b) of the ESA have been satisfied.
