The ministry issued an Environmental Compliance Approval to Halton Crushed Stone Limited for the establishment of sewage works for the collection, transmission, treatment and reuse of wash water from a proposed aggregate wash plant located within the Kirkfield Quarry site in the City of Kawartha Lakes.
The approved sewage works consist of:
- a primary settling pond complete with a 1 m thick compacted liner made of local low permeability clayey and silty materials and a minimum 1 m high perimeter containment berm, receiving wash water from the proposed aggregate wash plant, and discharging by gravity to a secondary (polishing) settling pond
- a secondary (polishing) settling pond complete with a 1 m thick compacted liner made of local low permeability clayey and silty materials and a minimum 1 m high perimeter containment berm, receiving effluent from the primary settling pond, and discharging by gravity to a tertiary (clarifying) settling pond
- a tertiary (clarifying) settling pond complete with a 1 m thick compacted liner made of local low permeability clayey and silty materials and a minimum 1 m high perimeter containment berm, receiving effluent from the secondary (polishing) settling pond, and discharging by gravity to a fresh water intake pond
- a fresh water intake pond complete with a 1 m thick compacted liner made of local low permeability clayey and silty materials, a minimum 1 m high perimeter containment berm, and a 3 m wide emergency spillway discharging to the existing quarry sedimentation pond, receiving effluent from tertiary (clarifying) settling pond and on an as-needed basis from the existing quarry collection sump, the fresh water intake pond discharging to the proposed aggregate wash plant for re-use in aggregate washing operations.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

The proposal is for a new Environmental Compliance Approval for industrial sewage treatment works serving Halton Crushed Stone Limited, located at 1563 Kawartha Lakes Road 48 in Kawartha Lakes.
The industrial sewage treatment works comprise of four ponds which create a closed loop and allow for settlement of fines, which are removed from the aggregate product.
The suspended solids will undergo settling in the primary settling pond, secondary (polishing pond) and tertiary (clarifying pond), and then returns to the fresh water intake pond via pump or gravity flow.
There will be no off-site discharge of surface water from the wash plant or from any of the wash ponds. The ministry may require monitoring of the industrial wastewater effluent discharge leaving the site.
