The site was approved to be used for the landfilling of wood waste. The entire property is 22 hectares, of which 11 hectares are used for landfilling. The landfill was approved for a maximum waste capacity of 875,000 cubic metres. Approximately 15 tonnes of wood waste per year is received from the EACOM Elk Lake Mill.
According to the 2017 volumetric survey, the active wood waste landfill had a volume of 114,632 cubic metres. In 2018 approximately 27,371 cubic metres was added and 3,792 cubic metres was reclaimed. As of December 2018 the approximate volume of the landfill is approximately 138,211 cubic metres.
The application is requesting to remove approximately 400,000 tonnes which is to be removed form the landfill site over a ten year period. The contract will be with Hermanns Contracting Limited to reclaim wood waste from the landfill site to create mulch. The contract and letter of intent was provided with the submission. The contract is for a 5-year term with an option to automatically renew for an additional 5-year term.
Reclaimed wood waste will be processed within the footprint of the waste disposal site and product will be stacked on site. Additional conditions have been added to the site's environmental compliance approval to address the wood waste reclaiming activities.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This application is for an amendment to EACOM Timber Corporation’s existing Environmental Compliance Approval No. A572102 (EACOM Elk Lake Landfill Site).
The EACOM Elk Lake Landfill Site operates as a wood waste landfill site with a total area of 11 hectares, within a total site area of 22 hectares, and is located in Elk Lake, Ontario. The facility services Ontario, and currently receives approximately 15 tonnes of wood waste per year from the EACOM Elk Lake Mill. The total capacity of the site is 875,000 cubic meters.
This application requests approval for wood waste to be removed from the landfill for recycling (to mulch) purposes. No change in hours of operation are included in the request; current hours of operation are from 9 AM until 12 AM. Approximately 400,000 metric tonnes of material are to be recycled over a ten year period.
