The Ministry of Municipal Affairs and Housing has received Applications 58-C-190981 in respect of the lands described as Parcel 638, Parts 4 and 5 of Plan 55R-4964 and Part 1 of Plan 55R-4964, on Part of Lot 5, Concession 2 on One Island Lake, in the Unincorporated Township of Fowler, in the District of Thunder Bay. The subject lands are roughly 15 kilometers north of the City of Thunder Bay.

Application 58-C-190981 was approved by the Ministry on November 20, 2019. Applicant has 1 year to satisfy the standard conditions of draft approval, otherwise the approval will lapse. The last date of appeal of this decision under the Planning Act is December 10, 2019.
Conditions include, that an application to consolidate the parcels be prepared and an undertaking from the person registering the documents be required agreeing to register the consolidations once the land transfers have been registered.

The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before December 10, 2019.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the specific part, or parts of the official plan amendment that you wish to appeal
- the reasons for your appeal
- the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

Description of Instrument
The purpose of application 58-C-190981 is to sever approximately 0.35 hectares of land from Parcel 638 and transfer it to the abutting west Lot 1 of Plan 55R-4964 to accommodate a driveway encroachment. Part 1 with the lot addition will be roughly 0.69 hectares in size; and the proposed retained lot will be approximately 8.8 hectares in size. These lakefront recreational lots each contain seasonal camps and outbuildings serviced by sewage systems and lake water.
