We issued Director's Order No.3858-BCFPDZ to NexCycle Industries Ltd. and NexCycle Properties Ltd. on October 7, 2019.

Minor changes were made to the Order since the instrument proposal was posted, including:

  • additional time has been provided to NexCycle to complete some of the the items in the Order
  • item numbers 11 and 12, which required the repair or replacement of mesh netting at the site, have been removed as NexCycle completed the items prior to the Order being issued

The rest of the issued Order remained unchanged from the draft.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

We propose to issue a Director’s Order ("Order”) to NexCycle Industries Ltd. (the operator) and NexCycle Properties Ltd. (the property owner) to protect human health and the natural environment from adverse effects arising from a waste disposal site operating without the required approval.

The operation is located at 50 McLean Road West in Puslinch Township, and processes recycled glass. The official description for the property is Part Lot 4, plan 677; Part Lot 26, Concession 7, Puslinch, Ontario.

Background

We have received, and continue to receive, complaints about this operation causing adverse effects to the natural environment, and possibly human health. The adverse effects have been verified by Provincial Officers.

The operation does not hold the required Environmental Compliance Approval which regulates waste processing facilities and sets conditions to make sure the operation doesn’t cause impacts to human health and the natural environment. There are no applicable exemptions for the operation to not have to obtain an Environmental Compliance Approval.

Some of the tools used by the operation to prevent waste and dust from impacting the natural environment are not working as they are designed and need to be fixed to help reduce and prevent further complaints and impacts.

Order requirements

The proposed Order requires the operator and property owner to:

  • apply for an Environmental Compliance Approval for a Waste Disposal Site (Processing)
  • submit financial assurance which guarantees that costs are covered for complying with environmental objectives
  • inspect the operation often to make sure dust, litter and odour are not causing adverse effects
  • do maintenance on equipment to make sure dust, litter and odour are kept under control

Environmental Protection Act references

The following sections of the Environmental Protection Act permit us to issue this Order:

  • control orders (Section 7)
  • remedial orders (Section 17)
  • preventive measures (Section 18)
  • order by Director (Section 44)
  • financial assurance – approval or order (Section 132(1))
  • orders, consequential authority (Section 196(1))
  • disclosure of orders and decisions (Section 197(1))

The following sections of the Environmental Protection Act are being, and/or have been contravened by, the operation and operator:

  • prohibition, discharge of contaminant (Section 14(1))
  • approval, waste management system or waste disposal site (Section 27(1))
  • prohibition as to deposit of waste (Section 40)
  • prohibition as to use of facilities, etc. (Section 41)
  • offences, general (Section 186(1))
