Decision on instrument
Application 60-C-192608 was approved on November 4, 2019. Conditions were added. Applicants have one (1) year to satisfy conditions otherwise approval will lapse.
The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Local Planning Appeal Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before November 24, 2019.
Non-standard conditions include:
- That prior to final approval, this Ministry must be advised by the NWHU that the severed and receiving lands have been inspected and are suitable for the installation of a subsurface sewage system or that the existing systems meet their requirements.
- That prior to final approval, written confirmation is received which states that there is adequate capacity to dispose of hauled sewage generated by the severed and receiving lands. This written confirmation should take the form of a letter from the holder of an ECA for an approved septage disposal facility, referencing the disposal facility and the related MECP approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the lots.
- That prior to final approval, an application to consolidate the PIN 42055-0072 with PIN 42055-0073 is prepared and an undertaking from the person registering the documents shall be required agreeing to register the consolidations once the land transfers have been registered.
- That prior to final approval, an application to consolidate the PIN 42055-0071 with PIN 42055-0070 is prepared and an undertaking from the person registering the documents shall be required agreeing to register the consolidations once the land transfers have been registered.

Appeal process for decisions published before June 1, 2021
You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Description of instrument
Proposal 019-0413 (Application 60-C-192608) will sever the approximately 0.07 hectare PIN 42055-0072 from PIN 42055-0071 as a lot addition to the abutting PIN 42055-0073. The proposed severed lot would be approximately 0.07 hectares after the lot addition with 97.24 metres of frontage and a depth of 12.51 metres. The proposed receiving lot would be approximately 0.48 hectares after the lot addition with 46.00 metres of frontage and a depth of 103.39 metres.
The proposed lot addition will allow the receiving lands (PIN 42055-0073) access to the Indian Lake Chain as the two shoreline parcels (PIN 42055-0071 & PIN 42055-0072) have merged.
