This new Environmental Compliance Approval (Waste Disposal Site) for the following:
- a waste disposal site (processing) for receipt and pre-processing of off-farm organic wastes and processing (anaerobic digestion) of the off-farm wastes with agricultural source materials for production of soil supplements and/or animal bedding materials and biogas
The approval is for expansion of the existing anaerobic digestion facility regulated under the Nutrient Management Act and consisting of a solids receiving bunker and feeder, three (3) off-farm waste receiving pits/pasteurizers, each having a holding capacity of 155 cubic metres, a regulated mixed anaerobic digester, biogas conditioning equipment and a waste gas flare. The existing regulated mixed anaerobic digester and the associated equipment and structures have been built in compliance with all applicable regulatory requirements.
The total area of the approved waste disposal site is 0.71 hectares. The site will be receiving 200 cubic metres of liquid off-farm organic waste per day or 200 tonnes of non-hazardous solid off-farm organic waste per day with an annual maximum of 60,000 cubic metres of liquid waste or tonnes non-hazardous solid waste. This is an increase of the annual amount of off-farm waste from 10,000 to 60,000 cubic metres/tonnes per year.
The existing off-farm waste receipt, storage and pre-processing infrastructure (facilities) will be used to manage the increased amounts of the off-farm waste which then will be mixed with the agricultural source materials in a new mixed anaerobic digester having a 7,000 cubic metre capacity. Generated biogas will be upgraded into the renewable natural gas prior to its injection into a natural gas pipeline. The total amount of off-farm waste stored at the site is not to exceed 200 cubic metres or 200 tonnes at any one time. A new flare will be installed to burn any extra raw biogas or any unsuitable for pipeline injection treated biogas.
Receiving hours of operation are 7 a.m. to 7 p.m., 6 days a week, and the processing will occur 24 hours a day, 7 days per week. The waste disposal site serves the province of Ontario.
Effets de la consultation
The ERO comment submitted within the comment period was from Municipality of Middlesex Centre and it was regarding the applicability of the current zoning. Since the applicability of zoning is a municipal consideration, the Ministry recommended that the proponent confers with the municipality so that the municipal concerns are addressed. Following additional clarification by the proponent, the municipality concluded that the current zoning is appropriate, provided that the applicant operates the new waste disposal site as an operation that is a part of the agricultural activities currently carried out at this location and receives only the off-farm waste types that are allowed for processing in the regulated mixed anaerobic digester regulated under O. Regulation 267/03 (Nutrient Management Act administered by the Ontario Ministry of Food and Agriculture - OMAFRA). Appropriate conditions regarding this were included in the ECA.
Between November 27, 2019 and November 29, 2019, the Ministry received 7 e-mails with public comments regarding this proposal. Even though the ERO comment period had already closed, we have considered all in-scope comments on the proposal. The following provides the issues identified in the comments and how they were considered/responded in our decision:
- Concerns about the possible air impacts, including odours, from the proposed waste disposal site (processing - anaerobic digestion)
Our response: The ECA conditions require the company to address odour impacts from the site, including proper maintenance and operation of the waste management equipment, closing the lids on pasteurizer tanks and limiting the duration of the off-farm waste storage in the solids bunker.
- Concerns about the possible impacts, (odours, groundwater, food production, soil quality, increased volume, impacts on endangered species) from spreading on agricultural land
Our response: This approval does not deal with the impacts from the farm operations or the spreading of digestate on land, as these activities are regulated by the OMAFRA and are out-of-scope of the Environmental Compliance Approval review process. Since the waste disposal site will be operated to produce an agricultural source material, as defined in O.Regulation 267/03, output testing and land application requirements from this regulation will apply.
- Concern about traffic volume
Our response: The off-site traffic is regulated by local municipalities and therefore is out-of-scope of the Environmental Compliance Approval review process. We were made aware that Municipality of Middlesex Centre is aware of this proposal and its potential for traffic impacts and intends to follow its own protocols to deal with this issue.
- Concerns about groundwater impacts from the proposed waste disposal site (processing - anaerobic digestion)
Our response: The ECA contains conditions that ensure protection of the groundwater at the site, specifically the spill containment requirements for all tanks/vessels containing liquid wastes and the run-off controls for the outdoor solids bunker.
- Concerns about the quality of the incoming off-farm wastes
Our response: The ECA contains conditions that set out the types of off-farm wastes that are approved for receipt and that require characterization of these wastes. Only the waste types currently allowed for receipt under the O.Regulation 267/03 and are already being received at the farm, are are approved for receipt at the approved waste disposal site. Either published data or specific testing data are required for all off-farm wastes received at the site. Off-farms wastes containing human body waste are not approved in the ECA.

Appeal process for decisions published before June 1, 2021

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see

- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
