On August 1, 2019 we extended the comment period for an additional 23 days. The new comment end date is August 31, 2019. The original proposal was incorrect in the project description, as such we have extended the comment period to accurately reflect the type of waste facility and type of waste which is being received, stored and transferred. This application is for a transfer station for asbestos waste limited to waste generated through removal activities carried out by the company. Storage is limited to 2300 kilograms of asbestos waste in one 20-yard storage container, and daily receiving is limited to 230 kilograms.
Asbestos storage and handling conditions have been imposed through conditions of approval, including requirements for:
- signage
- waste inspection
- packaging
- safe handling
- worker training
- safety equipment
- airborne asbestos monitoring, have been imposed to ensure airborne asbestos does not result in a nuisance or hazard to the public

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for a new Environmental Compliance Approval (Waste Disposal Site) for Eco Metal Recycling Inc. operating a waste transfer facility for asbestos waste only and servicing Ontario. This waste transfer site is a 0.17-hectare property and the facility currently receives, stores, and transfers off-site for final disposal at a licensed waste receiving facility asbestos waste. The facility operates 12 hours per day, 5 days per week. The maximum quantity of waste delivered to the site on any given day is 0.23 tonnes with a maximum on-site storage capacity of 2.3 tonnes of asbestos waste from commercial, industrial, institutional, and residential facilities before the storage container must be picked up and hauled off-site.
Original proposal
This proposal is for a new Environmental Compliance Approval (Waste Disposal Site) for a transfer and processing facility for Eco Metal Recycling Inc.
This transfer and processing site is a 1,500 square metre property located in the City of Hamilton, Ontario. The facility currently receives, transfers and processes hazardous waste and non-hazardous waste materials, and operates 12 hours a day, 5 days a week. The maximum quantity of waste delivered to the site on any given day is 0.23 tonnes per day.
The on-site storage of 2.3 tonnes, services the province of Ontario, and the site will receive hazardous waste oil and non-hazardous waste including asbestos, empty tanks and piping, scrap metal and general waste, from commercial institutional and residential facilities.
