We have issued a new Environmental Compliance Approval (Air & Noise) to KW Ready Mix Inc., a ready-mix concrete batching plant, equipped with two (2) cementitious material storage silos, one (1) dust collector, one (1) baghouse dust collector, one (1) natural gas fired boiler, and fugitive emiissions.

The equipment will be used for the delivery, storage and transfer of materials associated with the ready-mix concrete batching operations at the site located at 38 Forwell Road in the City of Kitchener, Ontario.

Contaminant emissions to the atmosphere include magnesium oxide, particulate matter, slag, nitrogen oxides, and magnesium carbonate.

One (1) comment was received through the Environmental Registry. The comment was reviewed and considered in the ministry's decision whether or not to proceed with this proposal. The following concerns were raised:

  1. Concerns that it is unclear what is being proposed and whether the assumptions in the air portion of the application are consistent with those in the noise portion.

Ministry's response: The facility is approved for two production scenarios as described in the Environmental Compliance Approval. The ESDM Report considered both scenarios while the Acoustic Assessment Report considered only the scenario with the greater potential noise emissions.

  1. Concerns in regards to the noise generated by the proposed operations on-site; number of sources, locations and their operational sequences, the proposed facility impacts at the existing receptors, as well as towards future development to the west, as per information available from the City of Kitchener.

Ministry’s response: The proposal's Acoustic Assessment Report demonstrates that the operations of this proposed facility will meet ministry's noise limits (in this case the exclusionary sound level limits) upon completed implementation of the proposed noise control measures, which should occur prior commencement of operation of the facility and its equipment. Ministry will impose specific noise conditions in relation to the number of trucks, their locations and orientation at the site, as well as the operational time sequences for the applicable time periods.

Following the implementation of the proposed noise control measure(s) and commencement of operation of the facility, an acoustic audit will be required so that the noise impact and compliance can be verified. First acoustic audit could be done by the acoustical consultant, and the second audit will be done by a third party/independent acoustical consultant.

Any other changes/modifications to the site operations and related noise emissions may trigger a need that the site's Acoustic Assessment Report be updated, i.e. the facility may need to apply for an amended approval.

  1. Concerns about the air emissions from the facility meeting the ministry criteria.

Ministry's response: The application has demonstrated that the operation of the facility complies with the ministry's applicable air requirements including but not limited to the air discharge requirements in Reg. 419/05: Local Air Quality Regulation.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application
