 No comments were received in response to the Environmental Registry notice. However, through the consultation process under the Niagara Escarpment Planning and Development Act, numerous comments were received.

Members of the community expressed concern regarding:

  • range of permitted uses under the proposed designations
  • protection for species at risk if development was allowed
  • existing overland drainage impacting other lands
  • need for more protective designations in the Niagara Escarpment Plan to limit the range of uses
  • sale of a portion of the former aggregate extraction site to a private landowner rather than acquisition by the municipality for a park
  • traffic, parking and illegal camping in Dyer’s Bay un-related to the re-designation

Ultimately, a settlement was reached at an Environmental Review Tribunal hearing which resulted in changes to the proposed Plan Amendment such that a more restrictive land use designation was applied to a portion of the property and the list of permitted uses was limited by the additional of site-specific policies.  

Other existing issues in the Minor Urban Centre of Dyer’s Bay arising from increased interest in hiking and camping and lack of public service facilities were made known to the local municipality as these matters are under their jurisdiction and not the Niagara Escarpment Commission.

Proposal update

This notice was updated on June 12, 2019 to advise the public that the
proposed Amendment will be the subject of a future hearing to be conducted by the Environmental Review Tribunal. Opportunity for public comment will be available at the hearing.
 

Description of instrument

The proposal is to amend the Niagara Escarpment Plan, to allow for a site specific change to the Land Use Designation from Mineral Resource Extraction Area to Escarpment Natural Area and Escarpment Rural Area relating to the surrender of the Aggregate Resources Act licence for a former gravel pit operated by the Municipality of Northern Bruce Peninsula in the County of Bruce. Approximately 10.7 hectares (26 acres) of the subject properties are currently designated as MREA in accordance with the ARA licence (Licence No. 4798) formerly issued on the site.

The site was rehabilitated to the satisfaction of the Ministry of Natural Resources and Forestry and the lands and features on the former extraction area meet the appropriate NEP Land Use Designation Criteria and Objectives to be re-designated as Escarpment Natural Area and Escarpment Rural Area.

Other public consultation opportunities

Pursuant to Sections 7 and 10 (1) of the Niagara Escarpment Planning and Development Act, the Niagara Escarpment Commission is required to furnish affected ministries and each municipality within or partly within the NEP Area affected by the Amendment with a copy of the proposed Amendment and invite comments within 60 days.

Section 10 (1) b requires public notification in local newspapers. Section (10 c) requires notification to the Public Interest Advisory Committee for their comment.

The NEP is required to request comments on the proposed Amendment from affected ministries; municipalities, interested agencies, as well as property owners within 120 metres of the subject property. Notice of this Amendment proposal will be placed in the local area newspaper, the Wiarton Echo.

Public comments may be submitted in writing to the contact listed at the Niagara Escarpment Commission until February 11, 2016.
