The ECA was issued on October 11, 2019 for an end-of-life vehicle (ELV) waste disposal site.

The hours of operation for the site are:

  • Monday to Friday from 7:00 a.m. to 5 p.m.
  • Saturday from 8:00 a.m. to 4:00 p.m.
  • Sunday from 9:00 a.m. to 4:00 p.m.

In addition to ELV's, ferrous and non-ferrous metals are also accepted and managed at the site. This operation is exempt from approval under Section 3 (2) 2 of Reg. 347.

A maximum of 36 vehicles/day will be received at the site. The maximum outgoing residual waste is 300 tonnes/day. Outdoor storage includes 150 unprocessed ELV's, 5000 tires and 150 vehicle shells.

The review of the application and conditions of the ECA ensure that the processing of ELV's ceases to be a significant drinking water threat.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

Description of instrument

This proposal is for a new Environmental Compliance Approval (Waste Disposal Site) for the use and operation of waste disposal site with a total area of 2.5 hectares to be used for:

  • the collecting,
  • handling,
  • transporting,
  • storing,
  • processing,
  • disposing and
  • transfer of End-of-Life-Vehicles (ELV).

ELV Recovery will be conducted within a 35 square metre sized vehicle solid material and fluid extraction shed. The shed has an open site for access to the building. The shed is located on the northwest side of the property along the fence line.

The facility will receive up to 36 vehicles per day and have a maximum on site storage of 150 and less than 5,000 tires (3,000 cubic metres) at any one time. The vehicle components include batteries, fluids, electrical switches containing mercury, battery cable connectors and tire weights containing lead, asbestos brake pads, ozone depleting substances and other halocarbons prior to the vehicles being shipped off site to steel mills.

The facility will operate 7 am to 5 pm, Monday to Friday, 8 am to 4 pm on Saturday, and Sunday seasonal 9 am to 4 pm and will service the province of Ontario.
