On July 31, 2019 we issued amended Environmental Compliance No. 4410-85LJ85 to GFL Environmental Inc. for an excess soil processing operation on Unwin Avenue in Toronto, Ontario. This approval allows the company to receive and process excess soil using physical and biological methods to reduce contaminant concentrations prior to reuse off-site.
Site storage is limited to 100,000 tonnes of soil and residual waste at any one time, and daily receiving is limited to 5,000 tonnes of soil per day with short-term exceptions for up to 7,000 tonnes per day to accommodate large projects.
Processing at the site will include:
- receipt and transfer of soils
- removal of debris from soils
- bioremediation
- soil mixing
Stringent documentation, sampling and analysis requirements have been imposed to ensure all soils received at and shipped from the site are properly characterized.
Stringent requirements for the reuse of processed soil have also been imposed to ensure that soils may only deposited at certain locations and that the soils are appropriate for reuse at those locations.
An environmental compliance approval for air emissions (ECA No. 7257-AXSTJK) was issued in tandem with this waste approval to limit potential air quality impacts from this operation.

This application was posted on the Environmental Registry for 45 days, with neighbour notification letters being distributed. Five comments were received on the registry, and one comment was received by email.
The responses included the following comments and concerns:
- prohibition on sending soil to sensitive sites
- documentation to include Phase 1 and 2 information
- testing frequencies should be adequate
- soil tracking and record keeping
- QP to attest when sending soil for reuse
- mandatory screening/separation of debris
- mandatory reporting to MECP if soil from facility is found to have exceed
- third party lab for testing
- require public liason committee
- D&O should form part of ECA
- dimensions of biocell
- sampling protocols be specified
- retain records for 7 years
- previous company conduct
- increase in receiving limits
- FA does not include hazardous soil
- fugitive emissions
- filter cloth to be installed
These concerns were addressed through prescriptive conditions in the waste approval. Comments regarding air emissions/pile sizes were addressed through the air approval review. Alleged previous conduct of the company was not considered as a factor in the approval of this ECA.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

Description of instrument
This proposal is to amend Environmental Compliance Approval (Waste Disposal Site) No. 4410-85LJ85 for GFL Environmental Inc.
The facility is a transfer station with a total area of 4.5 hectares, and is currently used for the receipt and transfer of non-hazardous petroleum hydrocarbon impacted soils and transfer of non-hazardous impacted soils at a maximum rate of 5,000 tonnes per day and at a maximum total storage of 100,000 tonnes at any one time.
The hours of operation are Monday to Saturday from 6:00am to 9:00pm, excluding statutory holidays.
The amendment is for modifications to the facility including increasing the maximum height for waste storage piles, updating soil analysis requirements, and updating the financial assurance.
