The ministry has approved an amendment to Environmental Compliance Approval (ECA) A582395 for the Golden Giant Mine Landfill of Newmont Canada Corporation, located in the Unorganized Township of Bomby, Ontario, approximately 40 km east of Marathon, Ontario.

ECA no. A582395 was amended to expand the landfill to allow for additional waste to be deposited at a maximum rate of 0.05 tonnes per day up to a total waste disposal volume of 50,600 m3 (including interim covers, but excluding final cover), which is between 40,000 m3 and 100,000 m3. This increase of 39,900 m3 to the currently approved total waste disposal volume is less than 40,000 m3. Therefore this expansion did not require an environmental assessment or an environmental screening process per O. Reg. 101/07. With the new total waste disposal volume of 50,600 m3 within the approved 1-ha footprint and based on closure design, the estimated remaining capacity is 6,040 m3. Hours of operation at the landfill are on Saturday from 10 AM to 11 AM.

More specifically, the amended ECA approval includes:

  • an increase of the total disposal volume of the 1-ha landfill to 50,600 m3
  • an update of the name on the ECA from Newmont Canada Limited to Newmont Canada Corporation
  • modification to the submission date of the landfill groundwater monitoring reports
  • continued acceptance of non-hazardous solid waste from the mine site, including non-hazardous filter cake sludge from the Newmont wastewater treatment plant as approved in ECA No.3943-99UQSM, per the operational specifications provided in the Design & Operations (D&O) Plan

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

Description of instrument

The Golden Giant Mine Landfill of Newmont Canada Corporation is located in the Unorganized Township of Bomby, Ontario, approximately 40 km east of Marathon, Ontario. The landfill operates under environmental compliance approval (ECA) no. A582395 for a waste disposal site. The landfill site is approximately 20 ha, of which 1 ha is permitted for landfilling of non-hazardous solid mine / mill waste to a maximum approved capacity of 10,700 m3. The 1-halandfill comprises two areas: an inactive portion of 0.5 ha which is covered by a layer of crushed quarry rock and an active portion of 0.5 ha where waste continues to be deposited. Per the 2017 topographical survey, the current total volume of waste deposited in the landfill is 44,500 m3.

This proposal is to amend ECA no. A582395 to expand the landfill to allow for additional waste to be deposited at a maximum rate of 0.05 tonnes per day up to a total waste disposal volume of 50,600 m3(including interim covers, but excluding final cover), which is between 40,000 m3 and 100,000 m3. This increase of 39,900 m3 to the currently approved total waste disposal volume is less than 40,000 m3. Therefore this expansion does not require an environmental assessment or an environmental screening process per O. Reg. 101/07. The purpose of this amendment to expand the landfill is to:

  • increase the approved total disposal volume of the 1-ha landfill to 50,600m3
  • update the name on the current ECA from Newmont Canada Limited to Newmont Canada Corporation
  • modify the submission date of the landfill groundwater monitoring reports from 31 March to 1 June to make it consistent with Newmont’s due date of 1 June for submissions of mine site reports to the MNDM
  • continue accepting non-hazardous solid waste from the mine site, including non-hazardous filter cake sludge from the Newmont wastewater treatment plant as approved in ECA No.3943-99UQSM, per the operational specifications provided in the D&O Plan
  • close the landfill site once maximum capacity is reached per the design details provided in the D&O Plan.
