The applicant is seeking leave to appeal a decision made by the director of the Ministry of Environment, Conservation and Parks to issue an Environmental Compliance Approval (Air) to American Iron and Metal Company Inc.

This notice is given by the applicant in accordance with section 47 of the Environmental Bill of Rights, 1993. The notice was prepared by the applicant and represents its position. It does not represent or reflect the views of the Government of Ontario, nor does the Government of Ontario make any representations about the accuracy of the content of this notice.

The applicant, David Kebick, seeks leave to appeal the Director's decision to grant the Environmental Compliance Approval (Air) under s.20.3 of the Environmental Protection Act, on the following grounds:

American Iron and Metal is already causing substantial noise impacts on our neighbourhood and we are concerned that this Environmental Protection Act (Air) will only exacerbate this problem. This is because:

  1. the new Environmental Compliance Approval (Air) was granted without including a noise impulse table(s) mandatory to operations;
  2. the new Environmental Compliance Approval (Air) allows for a more than doubling of the scrap truck traffic in and out of the yard per hour; and
  3. the Acoustic Assessment Report, included in Schedule A – Supporting Documentation of the Environmental Compliance Approval (Air) , has classified certain equipment in a manner that is problematic where noise impacts are concerned and believe this equipment was misclassified. Which would effect the results.

We have issued an Environmental Compliance Approval with Limited Operational Flexibility (Air), which replaces all the current Environmental Compliance Approvals for Air, and includes the addition of new, or historically unapproved, sources for all emissions from American Iron & Metal Company Inc., for a metal recycling facility located in the City of Hamilton, Ontario.

The approval includes all sources at the facility including:

  • sorting
  • bailing
  • shearing
  • shredding with magnetic and non-magnetic separation
  • metal cutting using handheld torches (oxyfuel and plasma)
  • material receiving
  • storage and shipping, and
  • ancillary operations

Emissions to the air from this facility include:

  • chromium
  • ferric oxide
  • lead
  • manganese
  • nickel
  • sulphur
  • particulate matter, and
  • nitrogen oxides

The Environmental Compliance Approval with Limited Operational Flexibility (Air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air). The limited operational flexibility conditions have an expiry date.

The company will be required to make an application for amendment at that time to renew these conditions.

Fifteen (15) comments were received by the Ministry through the Environmental Registry and one (1) comment was received by mail.  Comments received were reviewed and, where appropriate, were considered in the ministry’s decision whether or not to proceed with this proposal. The following concerns were raised:

  1. Concerns in regards to the noise and vibration generated by the operations on-site; the noise limits used in the acoustic assessment; and the explosions which may be generated by the proposed shredder.

Ministry’s response: The proposal's Acoustic Assessment Report demonstrates that the operations of this facility will meet Ministry's noise limits upon the completion of a Noise Abatement Action Plan, and demonstrated that the site currently complies with the Ministry's vibration limits.

Following the implementation of the Noise Abatement Action Plan, an Acoustic Audit will be required so that the noise impact and compliance can be verified by a third party acoustical consultant.  Any changes to the site operations will also require that the site's Acoustic Assessment Report be updated.

The noise limits used for the nearest and most exposed receptors to the south are lower than the recorded ambient noise in order to match the noise generated by the vehicular traffic along Nikola Tesla Boulevard and exclude the sounds from other industrial facilities.

Based on information received from the company, policies and procedures will be implemented to restrict the chances of an explosion occurring during shredder operations, including but not limited to supplier contracts and audits to prevent prohibited materials, shredder design to minimize noise and the potential for explosions, staff training for shredder inspection and operation, incident investigation by company Operations Manager and reporting to MECP.  Information received from the company indicated that the company’s operations will be adjusted to meet a zero explosion goal, and that the site and buildings had been designed to meet the requirements of the Ontario Building Code regarding fire services and fire routing, which were reviewed and approved by the City of Hamilton through the site plan approval process.

It should be noted that ECA (Air and Noise) applies only to s.9 EPA. Issues related to inappropriate land use/city zoning, residential property values, air and noise pollution from delivery trucks on public roads and future development of the area are beyond the scope of the ECA (Air and Noise).

  1. Concerns about the air emissions including dust emissions, torch cutting emissions, shredder emissions.

Ministry’s response: The application has demonstrated that the operation of the facility complies with the ministry’s applicable air requirements including but not limited to the air discharge requirements in Reg. 419/05: Local Air Quality Regulation.

A Dust Best Management Practices Plan was submitted as part of the application. Condition 8 has been included to require the company to implement the plan and update it.

The company submitted a Torch Cutting Procedure with the application. Condition 9 has been included to require the company to conduct all oxy-propane metal cutting in accordance with the plan.

  1. Concern about changes at the facility and a request that an assessment be completed for each change.

Ministry’s response: The Environmental Compliance Approval with Limited Operational Flexibility requires the facility to meet specific performance limits and maintain an up to date Emission Summary and Dispersion Modelling Report and Acoustic Assessment Report to reflect any changes and document ongoing compliance. Condition 6 requires the facility to submit a Written Summary Form to the Ministry annually which includes a summary of modifications.

  1. Concern about the cumulative effects from other scrap metal yard and industry in the area.

Ministry’s response:

The Cumulative Effects Assessment in Air Approvals Policy decision was posted to the Environmental Registry in April 2018 and came into effect on October 1, 2018. This policy strengthens and clarifies the consideration of cumulative effects when making decisions related to environmental compliance approvals and indicates when additional measures may be needed beyond current regulatory requirements.

Under this policy, no further action is required for the facility at this time. The Ministry will continue to look at other contaminants, sources and geographic areas and consult with public and stakeholders as we expand the cumulative effects policy over time.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
