An amendment approval is granted to to add glass recycling operations to the facility’s operations, as well as changes to the quantities of waste received and the processed materials stored at the site.

The site is permitted to receive 1000 tonnes of non-hazardous waste including recycled glass per day. The amount of stored non-hazardous waste is limited to 2,000 tonnes at any one time. The amount of stored material for marketing as industrial minerals will decrease to 15,000 tonnes. Storage of residual waste from glass recycling will be limited to 1,500 tonnes and maximum glass watste (processed and unprocessed). Storage will not exceed 7,500 tonnes at any time. All glass waste storage (unprocessed and processed) will occur inside the building. Residual waste from glass processing will be kept inside the building.

The site is approved to accept glass waste stream from company preapproved sources within Canada and the United States of America.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

This proposal is for an amendment to an existing Environmental Compliance Approval No. A130517. Opta operates a facility, located in Waterdown, that blends recycled mineral materials with raw virgin mineral materials to produce industrial mineral products for sale.

The industrial materials produced at the Opta facility are used primarily as silica free abrasives for blast cleaning and desulfurization products for the steel industry. Products are also used in the production of:

  • cement
  • supplied sands for retail and industrial applications
  • bunker sands for golf courses
  • filtration sands for water filtration systems

This amendment is to:

  • add glass recycling to the facility’s operations
  • propose adjustments to the types and quantities of waste and materials stored and received

The site will be permitted to receive 1000 tonnes of non-hazardous waste and new recycled glass per year, a decrease from the current 2500 tonnes.

The amount of stored non-hazardous waste will decrease from 15,000 tonnes to 2,000 tonnes at any one time.

The amount of stored material for marketing as industrial minerals will decrease from 75,000 tonnes to 15,000 tonnes.

Storage for residual waste from glass recycling will be 1,500 tonnes with an additional 7,500 tonnes of storage for glass material.

The new proposed glass stream will be a combination of:

  • municipal blue box collected glass through new Ontario EPR program
  • deposit grade glass from redemption centers
  • commercial waste glass such as windows/panes and other operations
  • various industrial non-hazardous waste glass streams

The facility will keep the same hours of operation and process all glass material indoors.
