An amendment Environmental Compliance Approval (ECA) was granted to Boem Berry Farms Inc. to amend the existing ECA No. 5692-CHR4PN for proposed Phase 4 greenhouse expansion development, located at 684 County Road 2 East, in the Town of Kingsville, County of Essex, Ontario

The approved expansion of the stormwater management works includes deepening of the existing stormwater management pond to serve a total of 39.678 hectares of Phases 1 to 4 drainage areas.

After the expansion, the approved stormwater management works consist of roof water drainage pipe systems, on-site storm sewers and swales, a rooftop runoff only lined irrigation reservoir, and a stormwater detention pond with a maximum active storage volume of 31,204 cubic metres, discharging via a new outlet into a municipal drain - North Jasperson Drain via private enclosed Repko Drain, and to the Branch of the Scratch Wigle Drain via existing east outlet pipe during extreme storm events.

The approval also includes a 395 cubic metres grassed ponding area and an oil/girt separator serving 0.911 hectare of Phase 4 parking areas, and one existing oil/grit separator serving 0.9 hectare of Phases 1 to 3 parking areas.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:

    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for an Environmental Compliance Approval amendment application serving Boem Berry Farms Inc. for the stormwater management works serving the Boem Berry Farms Inc. Greenhouse Development site including the expansion of the existing stormwater management facility with deepening of the existing S.W.M. pond and a new irrigation pond to accommodate the existing greenhouses and the proposed Phase 4 Greenhouse Expansion for collection, transmission, treatment and disposal of stormwater run-off from the lands located at 684 County Road 2 East, in the Town of Kingsville, County of Essex, Ontario. The facilities consist of the following:

  • roof water drainage pipe systems, swales and on-site storm sewers, discharging roof top runoff and other surface runoff to the stormwater detention pond
  • One stormwater management parking storage area, having a storage volume of 395 cubic meters with a maximum water depth of 0.815 meters for the 1:100 year storm event, completed with a 150mm diameter outlet pipe discharging a maximum release rate of 25 liters per second into the North Jasperson Drain
  • One stormwater management wet pond, having a storage volume of 313,204 cubic meters with a maximum water depth of 2.065 meters for the 1:100 year storm event, completed with a pump station, 525mm diameter outlet pipe with an orifice pipe discharging a maximum release rate of 170 liters per second into the enclosed Repko Drain and an emergency overflow spillway also directed to the Repko Drain.
